On a side note, when i was reading through the ordinance I got to the section of illegal, non conforming uses. The set- back still concerns me given that there is this "non- recorded" document out there for Days Survey. When I come to sell the property, I don't want someone to say that it is an illegal, nonconforming use because of this document. I would be happy to make it part of speech on Monday, or if I have a document from your office that you reviewed the setbacks and it is no big deal, I would feel more comfortable. Thoughts? I have reviewed the project submitted for the April 20, 2011 Technical Advisory Committee meeting, and offer the following comments: Alternative Transportation Review and Comments DEPARTMENT OF COMMUNITY SERVICES 1) The Bicycle and Pedestrian Plan requires the construction of a 5' sidewalk along Day Dr. Please revise the plans to include and label these facilities. 2) The City of Carnel Parking Ordinance requires that all commercial developments include bicycle parking. Bicycle parking spaces are required at a rate of five (5) bicycle parking spaces per one hundred (100) autorriobile parking spaces with a minimum of four (4) Spaces. Please see the City of Carmel's Parking Ordinance in order to determine the appropriate locations and construction details for the above. We request that. all responses to our comments be provided in writing. Failure to provide written responses may result in delay of the review process. I will accomplish this by using theexisting improvements and driveway with no further development to the exterior of the structure or Day Drive. I do foresee having to complete some cosmetics (i.e. paint work, gutter work, shingles, etc.), but the exterior of the structure is limestone and is in good shape. The only proposed exterior work is a possible sidewalk /decorative path from the driveway and landscape lighting. I also plan some site signage, at some point, along Day Drive. August 28, 1978 in the City Bldg. Roll was called and members present were: Glen Jensen, Jim Smith, Dr. John Durrer, Frank Regan and Jerry York. There were °no additions or corrections to the minutes of the July 24, 1978 meeting and Jim Smith moved they be approved as submitted. Seconded by Jerry York. Council's opinion regarding the 'no vote rule' policy was submitted. Mr. Boje suggested that the Plan Commission as well as the BZA should re- view this. An opinion from the Attorney General's .office is still to come. Mr. Regan announced that agenda item 3b, Eden Village Apts., has been tabled at the petitioner's request. No item will be considered after 11:00 P.M. E. Public Hearings la. 7:30 P.m., Public Hearing on Docket No. BA 28 -78, Variance Appli- cation to convert house to general offices use located 9616 Day Dr. Sign to follow the business requirement` in the ordinance. Present zoning is S -2 residential. Filed by Richard Mantel for Earl Thacker. The Public Hearing opened at 7:42 with Mr. Mantel, attorney, making the presentation. Mr. Mantel introduced Mrs. Stintara of Graves Real Estate and Mr. John W. Harvey of Jack Harvey and Assoc., Mr. Harvey is the pur- cha ser of the property subject to, attaining a variance for business usage (Manufacturers Representative office). Mr. Harvey plans to leave the exist ing structure unchanged on the outside. The inside will be converted to offices for four men and one receptionist. It will appear as a residential dwelling. There will be no sign. Mr. Mantel read a statement of hardship (which is a part of the file). Mr. Mantel said the property won't ,sell as residential with Foxworthy Ford behind. Photos were presented. A property map of Clay Twp. was shown. There will be off street parking to the rear for 6 cars. Landscaping is to be around the parking perimeter. Mr. Mantel said they feel that this may serve as the needed buffer to further development to the west. Color photos were submitted. Walt Sheiback, 2527 Pleasant Way, expressed opposition stating that there was originally to have been a green buffer between Thacker's property and Foxworthy and the economic hardship is Mr. Thacker's own doing. Mr. Sheiback expressed concern that if this is approved others surrounding will want variances. Ray Manua,. 9628 Day Dr., concurs with Mr. Sheiback. Mike Shepherd, 2543 Pleasant Way, questioned the property values. The Public Hearing closed at 8 :15. Mr. York called attention to the considerations for this property that were turned down in April Mr. York said the hardshiparguement is not a valid arguement and the Board would not be doing its duty if a� variance is granted on this property. Dr. John.Durrer moved that BA 28 -78 be approved. Seconded by Jim Smith. Finding of fact forms were completed. The vote was 1 For (Mr. Regan) and 4 Against. Motion denied. 2a. 7 :45 P.M., Public Hearing on Docket No. BA 29 -78, Variance Appli- cation for building setback line 2.8 feet, located lot 2, Brookshire North, Sec. 1, 13082 Andover Dr. in R -1 zoning. Filed by Will Goering II for Carmel -Clay Building Trades Corp. The Public Hearing opened at 8 :25 with Mr. Goering, attorney, making the presentation. The Carmel -Clay Bldg.
