I.f 1. The grant of this variance will not be
contrary to the public interest, due to the

enforcement of the zoning ordinance will
result in unnecessary hardship because: the
site is located adjacent to office and
commercial land uses today, so it would make

2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because: the site is located adjacent to office and commercial land uses today, so it would make
sense to permit this property to be used for a small scale office use.
3. The use or value of the area adjacent to the subject property will not be substantially affected in any
adverse manner because: the site is located adjacent to office and commercial land uses today, and it only gains
access to 96` Street from Day Drive.
4. The need for the variance arises from a natural condition peculiar to the subject property because: Day
Drive dead ends to the north, so the only access is to 96` Street, and the site's location is very close to the very
busy intersection of 96 Street Keystone Parkway, which is lined with office and commercial uses in the near
vicinity.
5. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan
because: The Carmel Clay Comprehensive Plan's (C3 Plan) 96th Street Westfield Boulevard Subarea Plan
shows this northwest quadrant of the intersection of 96th St. Keystone Pkwy. as remaining and becoming a
commercial area.
Recommendation: The Dept. of Community Services recommends positive consideration of.Docket No. 11030007 UV,
after all questions and concerns (if any) have been addressed.
