The approval of this variance will be injurious to the public health, safety, morals and general welfare of the community because: The existing barn, which is approximately 36.5 feet in height, is visible from adjoining properties and thereby adversely affects the general welfare of the community as it is unsightly and not harmonious with assessors buildings related to adjoining residential homes. 2. The use and value of the area adjacent to the property included in the variance will be affected in a substantially adverse manner because: The existing barn, which is approximately 36.5 feet in height, has been demonstrated to have a material adverse impact on the value of adjoining properties, as evidenced by the affidavit of Karen Hyde French dated April 18, 2011. 3. The strict application of the terms of the Zoning Ordinance to the property does not result in practical difficulties in the use of the property because: The proposed assessory bam can be constructed in a manner so that it is compliant with the Carmel Zoning Ordinance and any practical difficulties that exist have been caused by the actions of the Petitioner. DECISION IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards Variance Docket No. 1103001.1 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
