S f t l� I L b t f Pyre e 3 i i G 1 General Info Analysis: The petitioner seeks variance approval to have an accessory building with a height about 8 feet taller than the maximum height permitted. The zoning ordinance defines Building Height as the vertical distance from the lot ground level to the highest point of the roof for a flat roof, to the deck line of a mansard roof and to the mean height between eaves and ridges for gable, hip and gambrel roofs. The building height is measured halfway up, between the ridge and eaves, so an accessory structure could actually be taller than 18 -ft. This accessory building is located at the southwest corner of the 4.17 -acre property, and has 1 -ft side yard and rear yard setbacks. The nearest house is 115 feet away. The unique roofline of this structure allows much natural light to enter the space. Please see the informational packet for more detail. Findines of Fact: 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The accessory structure sits back 18 feet from the side and rear property lines. That part of the lot is heavily wooded, which partially screens the view of the accessory building from the neighbors. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The accessory structure sits back 18 feet from the side and rear property lines. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The accessory structure exists today, due to a permit issued by the Building Permits Dept. and the roof structure would now have to be modified, most likely at the property owner's expense, and lowered to meet the maximum height requirement.
