FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
the proposed signage for Crown Liquors will be similar to the signage that currently exists for the 106 Street
Grill, which is located immediately across the street.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the proposed additional sign complies with the Sign Ordinance size requirements and the total tenant sign
package is similar to other tenant sign packages in the corridor.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in
the use of the property because:
The Crown Liquors tenant space is oriented to both Michigan Road and 106 Street. The entrance to the
tenant space faces Michigan Road, so an identification sign is necessary on that facade, just like the other
tenants have over their entrances. Being the end tenant in the building, Crown Liquors also faces 106
Street, from which it has the best viewability by passing traffic. So, an identification sign on the south side of
the tenant space is also necessary for west -bound traffic on 106`" Street.
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards Variance
Docket No. 11030013V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated
herein by reference and made a part hereof.
