Dear Mr. Lyons:
The 1945 Flood. Control Act, IC 13 -2 -22, provided for regulatory authority by the
-State of Indiana over all construction, excavation, or filling within the floodway
of any Indiana river or stream. Enclosed is a copy of the staff report and the
permit from the Natural Resources Commission for the application under this statute.
Please review the permit thoroughly giving special attention to the limitations
and conditions under which it was granted. You may appeal any portion of this
permit by the procedures indicated on the attached sheet.
The approval of this project by the Natural Resources Commission will be considered
void unless construction is initiated within two (2) years. The permit must be
posted and maintained at the project site.
The enclosed permit is not a waiver of any local building ordinances or other
state or federal laws.

PERMIT APPEAL PROCEDURES
The enclosed permit or any of the limitations and conditions which it contains
may be appealed by either:
1. Requesting a reconsideration of the decision of the Advisory Council on
Water and Mineral Resources by the Natural Resources Commission within
18 days from the mailing of this notice. This reconsideration may be
initiated by making a written request directed to John N. Simpson, Director,
Division of Water, 2475 Directors Row, Indianapolis, Indiana, 46241; or
2. Applying for review, under the administrative adjudication act, IC 4 -21.5,
within 18 days from the mailing of this notice. To obtain this review,
a written petition must be directed to James M. Ridenour, Director, Department
of Natural Resources, Room 608 State Office Building, Indianapolis, Indiana,
46204.
The request should contain the specific reasons for the appeal and the portion
or portions of the permit to which it pertains. If an appeal is made within paragraph
1 or 2, the final agency determination will be made by the Natural Resources Commission.

This certificate is Issued to Indianapolis Water Company
in accordance with an application dated May 10, 1988
filed by G.S. Lyons, Senior Vice President
for water treatment plant along West Fork White River upstream of the East 116th
Street Bridge near Fishers, Hamilton County in the SEA, Section 34, T. 18 N.,
R. 4 E., UTMN= 423500, UTME= 580800
upon the finding by the Commission that the proposed work will not in the reasonably foreseeable future
interfere with flood control in the State, or adversely affect the efficiency of nor unduly restrict the capaci-
ty of the floodway or constitute an unreasonable hazard to the safety of life or property, nor result In
an unreasonable detrimental effect upon fish, wildlife or botanical resources. The Commission approves
the proposed work, subject to the limitations and conditions stipulated below, provided the project is
constructed and maintained in accordance with the plans, specifications and other data submitted with
the application. There shall be no deviation from said plans unless the proposed change in plans shall
first have been submitted to and approved in writing by the State of Indiana acting by and through Its
Natural Resources Commission.
LIMITATIONS AND CONDITIONS
This approval granted with the conditions that: (1) no felled trees, brush or
other debris be left in the floodway of the stream, (2) all disturbed areas be

Further limitations and conditions are that notice shall be given the Commission five days prior to the
beginning of construction. This approval shall become void If construction of the project has not been
started within 24 months of the date of this Certificate. The approval by the Commission does

TITLE: WATER TREATMENT PLANT ALONG WEST FORK WHITE RIVER
NEAR FISHERS

PROJECT DESCRIPTION: The applicant proposes to place part of a water treatment
plant in the floodway along the right (west) bank of West Fork White
River. Those portions of the proposed treatment plant that lie in the
floodway are: one (1) intake channel, one (1) presedimentation basin,
three (3) sludge lagoons and an area of fill. The intake channel will
extend 600 feet landward from an intake screen located in the channel to a
presedimentation basin. The presedimentation basin will extend approxima-
tely 750 feet southwest of the intake channel exit to a lift pump inlet.
The width of the intake channel will be 10 feet and the width of the pre
sedimentation basin will be 30 feet. The three (3) sludge lagoons will
have dimensions of 100 feet by 150 feet and will be located approximately
850 feet landward of the West Fork White River channel centerline. The
fill area will consist of a ridge of material with an average width of
approximately 50 feet and extending approximately 300 feet into the flood-
way. The maximum height of the fill will be 2 feet over existing grade of
about 736 feet, M.S.L.

DRAINAGE AREA: Approximately 1174 square miles.
HYDROLOGY: Recorded historic flood information indicates that the March 1913,
April 1964 and June 1958 floods reached elevation of 747.0, 742.0 and
741.5 feet, M.S.L., respectively, at the site. It is estimated that the
100 -year frequency flood will reach an elevation of about 745.0 feet,
M.S.L.

COMMENTS BY DIVISIONS: The following review comments have been submitted con-
cerning the above reference project:
Division of Water: The proposed water treatment plant will provide an expanded
potable water supply for the service area of the Indianapolis Water
Company. The intake channel, presedimentation basins, and sludge lagoons
will lie below existing grade. The proposed area of fill will block
approximately 1% of the floodway flow area and should therefore have no
adverse effect on flood flows.
Division of Fish and Wildlife: Fish, wildlife and botanical resource losses
as a result of this project should be minimal and reasonable; however, all
clearing of (woody) vegetation should be held to the absolute minimum.
All bare and disturbed areas should be suitably protected and revegetated
to prevent erosion during and after construction. A suitable mixture of
grasses and legumes should be utilized. In addition, the wooded corridor
along the river should not be cleared except for the minimum necessary to
construct the intake channel.
Division of Forestry: No significant impact upon commercial timber resources
anticipated.
Division of Nature Preserves: The Nature Preserve and Natural Heritage Program
data base shows that there are no dedicated nature preserves, no known
high quality natural areas, and no species of plants or animals that are
considered rare, threatened or endangered that will be affected by this
project.
Division of Outdoor Recreation: This project will not directly affect any
component of Indiana's Natural and Scenic Rivers System. No Land and Water
Conservation Fund projects are affected by this action.
CUMULATIVE EFFECT: Since nearly the entire project will occur below existing
grades in the floodway this project will not have a significant impact on
flood stages. The following projects have been approved by the Advisory
Council and /or Commission:
G -3,620 Home approved August 23, 1973
G -6,913 Office building approved August 27, 1981
G -7,794 Pole barn approved June 28, 1984
U- 10,701 Is a related project by the Water Company and is currently
under review
The combined projects will maintain the efficiency of the floodway.
CONCLUSIONS:
The proposed project, with conditions specified in the RECOMMENDATION, will not
unduly restrict the capacity of nor adversely affect the efficiency of the
floodway, will not constitute an unreasonable hazard to the safety of life or
property, and will not result in unreasonably detrimental effects upon the fish,
wildlife or botanical resources.

tank with provision for future expansion.
2. IWC does not anticipate that operation of this plant
will 'adversely affect ground water levels off the
proposed site'We intend to-develop mgd of well

3. No sludges aenerated.in theIWC plant will be
discharged into any sewer that reaches the Carmel

Attached is a letter dated July 27, 1988 from Indianapolis Water Company
in response to my Memo dated July 19, 1988 attached.
The Indianapolis Water Company response has been reviewed by Don Silvey
and Don tells me he has reviewed it with Steve Andrews.. They both feel
the Indianapolis response is acceptable. Personally, I would prefer to
see a little more concrete wording in their assurances, which would
afford the City more protection.
In any case, we now have the responses of Don Silvey, Steve Andrews and
myself. The final decision is yours as to whether this is acceptable.
I had a conversation with Mr. Broyles Friday, July 29, 1988, and he was
extremely anxious to know if his letter would be acceptable. I told
him that as soon as your review had been made, I would contact him
immediately.
Please let me know your thoughts on this matter and I will` communicate
it to Indianapolis Water Company.

AFFIRMATION OF STATEMENTS TO

THE CITY OF CARMEL
The Indianapolis Water Company (IWC) reaffirms its
statement to Carmel and the Board of Zoning Appeals that:

day) surface water treatment plant and ground storage
tank with provision for future expansion.
2. IWC does not.anticipate that operation of this plant
will adversely'affect ground water levels off the
proposed site. We intend to develop 2 -3 mgd of well
capacity on the site to facilitate construction. These
wells will be held as standby should dilution of the
stream be necessary.
3. No sludges generated in the IWC plant.will be
discharged into any sewer that reaches the Carmel
wastewater treatment plant.
4. IWC does not anticitaatd that any discharges from this
plant into White River will adversely affect the river
and thus should not in any way affect Carmel's permits
to discharge to the river. Nor.does IWC"anticipate
that the City of Carmel will incur any. added cost of
treatment at their sewer plant because of any

Dear Rick:
The following addresses Carmel's recent concerns about our
proposed water plant being below an existing Town of Fishers
sewage plant outfall and above a proposed Fisher's outfall at
96th Street.
We have been monitoring the quality of the river above and below
the existing Fisher's outfall and have not found the effluent to
have any deleterious effect on the river or our proposed intake.
As regards to the affect that this water plant will have on the
proposed outfall at 96th Street, the answer is none.
Our proposed water plant will require additional release from
Morse Reservoir to maintain White River flow during a low flow
condition, in addition to that already released for our existing
W. 16th Street plant. Thus, this new plant would not have any
impact on what happens at either the existing Fisher's outfall

AFFIRMATION OF STATEMENTS TO
THE BOARD OF ZONING APPEALS
THE CITY OF CARMEL
The Indianapolis Water. Co. reaffirms its statement to
Carmel and the Board of Zoning Appeals that:
1. The Indianapolis Water Co. proposes to build a 24 '`iGD
surface water treatment plant ground storage tank.
2. That operation of the 24 MGD plant shall not adversely
affect ground water levels off the proposed site beyond
the construction period.
3. No sludges generated in the INDIANAPOLIS WATER
COMPANY plant be discharged into any sewer that reaches
the Carmel wastewater treatment plant.
4. No sludges generated in the INDIANAPOLIS WATER
COMPANY plant will be discharged into White River which
would (IN ANY WAY) adversely affect any discharge
permits (NPDES) or other, which Carmel has at any point
in time. That is the City shall be protected from added
costs of treatment at their sewer plant that would. be
affected. by any discharges of the INDIANAPOLIS WATER
COMPANY plant.
5 We w i l l maintain a minimum stream flow in White River
past Carmel' wastewater plant, at 96th street of a least.
83 cubic feet per second or (54 mgd) million gallons per
day.
G. We do have ample storage capacity in Morse reservoir to
maintain the stream flows at a minimum of 83 cfs or
(51• mgd.) under, any weather conditions.
The above affirmations are being offered to the Carmel. Board
of Zoning Appeals and the City of Carmel_ to provide the requested.
assurances and may he relied upon in_granting the requested
approvals for permits and planning by the City of Carmel.

Subsequent to our telephone conversation of July 13 concerning the
drainage at our proposed water treatment plant located north of 116th
Street on River Avenue, the following will be coordinated with your office
during the final design of this facility:
1. Detail crossections and profiles of the roadside drainage.
2. Redirection of the south property drainage more across our
property to the river in lieu of the existing swale across
adjacent property owners.
3. Redirection of drainage from the north along the north drainage
easement to the river in lieu of across our property.
As I mentioned we are currently looking to obtain a Special Use
classification for the site and that the above will be developed during
final design of the facility, which is a considerable expense we do not
wish to incur unless we know that we can build on the site.

Dear Jim:
The following is what was requested in our meeting of July 12. The
existing White River Purification Plant located at 950 W. 16th Street is
our canpany's main plant and represents 70% of the water treated and
pumped by the Indianapolis Water Canpany, which includes central, south,
west and southeast Indianapolis with the capability of bleeding to the
Indianapolis North side. The supply for the existing plant is the White
River, via the canal at Broad Ripple, supplemented by release from Morse
Reservoir during low flow. So obviously with the investment we have at
this site, this plant will still remain a viable main plant not affected
by the construction and operation of our proposed White River North plant
north of 116th Street.
Due to a recent study conducted by our consultant, Black Veatch, in
1985 the net available yield of the Morse Reservoir White River during a
period of the two year drought of record is 87.3 MGD, this is up from the
previous estimate of 75 MGD, the difference of which allows for the new
plant. Of course these numbers are an average daily 'and would be higher
in the summer and lower in the winter. Please refer to Bob Miller's
letter of May 2nd, copy attached, to you showing our lowest daily
production'at our existing plant for the previous 10 years.
The existing White. River" plant is very secure and flexible with two canal
intakes, three settling basins, 20 filters in two filter buildings, two
sources of pumpage and multi- conduits to get the water away from the
site. It would take a total disaster to wipe us out canpletely, which is
highly improbable, any damage to a portion of the plant during drought
conditions would be repaired or jury- rigged during round the clock efforts
to be back in service therefore it is unlikely that the flow in White
River would be disrupted. We have no plans to replace the White River
plant or reduce its capacity.

I have reviewed your site plan for a proposed new water treatment
plant and pumping station in Hamilton County and find no objections
to the proposed elevations. The air space zoning in effect for
Indianapolis Metropolitan Airport would permit construction of a
building not to exceed 250' above ground level at that proposed site.
Since it is over 1 mile from the Airport, no potential hazard is
threatened and the filing of a form 7460 would not be required.
We appreciate your submitting your plans to the Airport Authority
for review and if you have further questions, please feel free to

Attached is the Proof of Publication, for the above referenced Docket,
from the Noblesville Ledger. Also attached are two slightly revised
copies of the site plans, for your file, with the revisions requested by
Jerry Liston of the Hamilton County Surveyors Office.
I have met with Jim Hufford of Hamilton County Highway and we will
increase the pavement width from the existing 18 feet to 24 feet along our
road frontage. This extra six foot of width will be on the east side of
the existing pavement. We will also restore any damaged pavement along
River Avenue due to our construction at our expense.
I have also notified the Indianapolis Airport Authority about our proposed
tank and they are checking to see if it affects them.

existing culverts under River Avenue, the 15 foot drainage easement along

the road from 18 feet to 24 feet along our road frontage. This six foot
extension will be to the East on our property. We will also correct any
damage to the road due to our construction traffic.

Dear Rick:
Attached is a letter dated May 25, 1988, from the Department of Natural
Resources stating that they foresee no problems with our planned
construction of the water treatment plant and pumping station at the
proposed site along River Avenue. We are still receiving receipts from
the Postal Service on our notification mailing to adjoining property
owners and I will transmit these to you once I have them all collected.
Regarding the other permits necessary for the construction of the plant,
we have submitted site plans to both the Hamilton.County Surveyors office
and Hamilton County Highway office and expect their replies shortly. Once
the reclassification of the site is complete we will have our Consulting
Engineer, Black Veatch, develop detail plans for construction after
which we will file for the permit from the Indiana Department of Fire
Prevention and Building Safety prior to starting construction. During
design we will be talking to the Indiana.Department of Environmental
Management for permission to discharge our waste sludge back to White
River; if this is denied we will negotiate with Carmel Utilities about
accepting our sludge into their waste treatment system. We have had
preliminary discussions with Jim Dougherty about this sludge disposal
possibility; if they cannot accept our sludge then the sludge lagoons
would become drying beds with eventual disposal at a landfill. We do
intend.to tie into the, Carmel Sewer System for domesticwaste and have
discussed this with.Mr. Dougherty. During design we will submit plans to
the U.S. Corps of Engineers for their approval of the river intake
structure. We are still talking to the Water. Supply Division of the
Department of. Environmental Management to determine if they wish to review
the plans prior to construction and as yet have not received a reply.
The above permits, as I mentioned previously, cannot be obtained without
full detail design plans, a considerable expense we do not wish to incur
unless we know that we can build on the site. If the Special Use
reclassification is approved we would be happy to..furnish these permits to
your office as we obtain them and prior to any construction taking place.

RE: White River North Water Treatment Plant
I have reviewed the above plaans and have the following comments:
1. Add site location map to plans
2. What road improvements are to be made along River Avenue? (side ditch, culverts
etc.)
3. Show existing and proposed Right of Way for River Avenue on plans.
4. Recommend 15' drainage easement along North and South property line.
5. What type of screening is to be used?
6. Note soil types on plans.
7. Need copy of boundary survey.
8. Show existing culverts under River Avenue. Show size and type of these pipes.

the West Fork White River

Dear Mr. Lyons:
This letter is to update you on the current status of the proposed water
treatment plant and distribution system along the West Fork White River near
Fishers, Hamilton County.
The Division of Water along the other commenting Divisions within the Department
of Natural Resources have reviewed the project and foresee mo problems with
the planned construction. The project will likely be recommended for approval
to the Advisory Council on Water and Mineral Resources at their July meeting.
