Dear Mr. Hollibaugh:
As required by referenced commitments, enclosed are the latest revisions of the Spill
Prevention Control and Countermeasures (SPCC) Plans for North Indianapolis and Carmel
Sand. The Plan for Carmel Sand covers the Mueller Property North. The Plan for North
Indianapolis covers the Mueller Property South. Last year's plans were prepared in three-
ring binders to simplify future updates. The enclosures should be inserted in your copy of the
plans per the instruction included.

40 .CFR112.5(a), (b) and (c) requires the SPCC Plan to be amended whenever there is a change in facility
j design, construction, operation, or maintenance, which materially affects its potential to discharge to navigable
waters of the United States or adjoining shorelines. In addition, the owner or operator must complete a review
and evaluation of the SPCC plant at least once every five (5) years. Amendments to the Plan shall be made
within six (6) months of the change or review, with technical amendments certified by a Professional Engineer
(PE). Administrative updates such name or phone number changes do not require PE certification.

Hydraulic Fluid Spill
Dear Mr. Pace:
I spoke with Jerry Smith last Wednesday to report a spill of hydraulic fluid from Martin Marietta's
dredge located at 10851 Hazel Dell Parkway. He requested that I send you a letter outlining the
measures taken. This is the same site where you attended the training class I conducted last
November. The spill was due to a hydraulic hose rupture. The fluid is a marine based substance. An
estimated 20 to 25 gallons were spilled. The employees said that most or all of the spill was retained
on the dredge structure and cleaned up with absorbent materials. Jerry Crane, Plant Manager,
confirmed the quality of the cleanup effort.
I have enclosed a copy of the report form that I will file in our SPCC Plan. Both Jerzy Crane and I
have a copy of that plan.

DETAILED DISCHARGE REPORT FORM
Reporter's Name and Date: Max Williams received call from Jerry Crane, Plant Manager, on
3/24/10 at 4:31 PM.
Location of Discharge: Carmel Sand dredge lake located at 10851 Hazel Dell Parkway, Indianapolis,
Indiana, 46280.
Date and Time Discharge Occurred: 3/24/10 at approximately 3:45 PM.
Material and Amount Discharged: Estimated 20 to 25 gallons of marine -based hydraulic fluid with
most or all being retained on dredge.
Source of the Release: Ruptured hydraulic hose on dredge.
Cause and Circumstances of Release: Ruptured hose.
Countermeasures to Contain and Clean -up Discharge: Absorbent materials were used to soak up
spilled fluid. Employees believe that little if any got into water. Plant Manager confirmed the quality
of the cleanup effort. Hose will be replaced.
Personnel/Agency Contacted Regarding-Discharge Procedures: Called Carmel Utilities (571 -2580
after hours number) at 4:52 PM. Called IDEM -OER (233 -7745) at 4:55 PM. Received call from
Jerry Smith from Cannel Utilities (650 -5582) at 5:08 PM requesting that letter be sent to Paul Pace
outlining what actions were taken. Received call from Dave Cage of IDEM -OER at 5:12 PM. Mr.
Cage was satisfied with cleanup efforts. Spoke with him on 3/26/10 to get Incident Number
200803183.

Corrective Actions Implemented to Prevent Recurrence of Discharge: Hose will be replaced.
Discharge Report Sent To: Report to be filed in SPCC Plans with Plant Manager and Senior
Environmental Engineer. Copy will be sent to Paul Pace of the City of Carmel Utilities.

03 -183. Both agencies were satisfied with cleanup. No inspection was made.

o Plant personnel made use of absorbent materials, and then called Jerry
Crane, who called Max Williams in a timely manner. Was able to report
spill within two -hour requirement.
o Fast reaction by plant personnel.
Concerns:
S o Area is in wellhead protection area. Carmel Utilities asked that all spills
in dredge lake be reported to them.

O Date and Time: July 26, 2008, between 2:00 and 2:30 AM
Contact: Lee Williams called Max Williams at 3:37 AM
O Material spilled: Crusher oil and water
O Amount spilled: Estimated 50 gallons of oil /water mixture
O Cause: Leak in line allowed water to drain into crusher oil tank causing overflow
O Location of spill: In low area holding water running approximately 300 to 400
feet south southwest of cone crusher
O Cleanup measures: Absorbent booms and pads
O Agency contact: Max Williams called David Cage of IDEM's Office of
Emergency Response at 4:01 AM. Spill was reported because it would not be
possible to accurately evaluate spill until daylight. Incident No. 2008 -07 -208
was assigned. No inspection was made.
O Disposal: Absorbent materials used were disposed at South Side Landfill
O Positive aspects:
o Lee Williams made use of absorbent materials, and then called Max
Williams in a timely manner. Was able to report spill within two -hour
requirement.
o Spill did not reach Strakis Lake, therefore spill would not have actually
been reportable as could be seen in daylight.
o Negative aspects`
o Scheduled repair project had not yet been completed, resulting in spill.
o Used most available absorbent materials and ha d to order more after
cleanup.
