NOTICE
This is to inform you that a public health nuisance exists on the property at 12933 Wembly
Court in Carmel, Indiana. Sections 6-77(c) and (k) of the Carmel City Code construes the
following conditions to be public health nuisances:
(c) Accumulations of decayed animal or vegetable matter, trash, rubbish, rotting
lumber, bedding, packing material, junk vehicles, scrap metal or any material in
which flies, mosquitoes, disease -carrying insects, rats or other vermin may breed,
or may be afire hazard;
(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building
materials, machinery, dead trees, or parts thereof, upon any premises in a
residential area.
You must remove this public health nuisance within 24 hours of receipt of this Notice.
Failure to abate this public health nuisance in the time specified will result in the City causing
the same to be abated and will charge the cost thereof to the owner, occupant or person causing,
permitting or maintaining the same.

Per our phone conversation, attached you will find the two tax statements we
recently received. They both refer to a Carmel City -Weed Lien and are identified by
receipt #0048996.
You stated that there was a billing for weed and trash removal of $140.00 for work
done back in the Jan/Feb 2003 timeframe. We did not purchase the property until
July of 2003. in addition, we no longer own this property — we sold the property and
closed on this sale in March of 2004.
Please review this information and give me a call in my office at 848-1372. Thanks

To Whom It May Concern:
The following is a bill incurred by the Carmel Street Department for trash pick up
at 12933 Wembly Court. Items picked up were leaves, aerosol cans, yard chemicals,
boxes, make up, and cabinet, just to name a few. Trash was taken to Boone County
Resource Recovery System, Inc. All bills were paid by Carmel Street Department. This
was done at the request of the Enforcement Officer of the City's Department of
Community Services.
1) 2 men for 2 hours to load and haul items
to landfill = 4 his. x $20.00/hr. $ 80.00
2) Pick up trash for 2 hrs. x $20.00/hr. _ $ 40.00
3) Cost at Boone County Resource Recovery $20.00

§ 6-80 PUBLIC HEALTH AND SAFETY § 6-81
(a) INsFEcnoN OF PREMISES. Whenever complaint is made to the Mayor that a public
nuisance exists or has existed within the City, he shall promptly notify the Building Commissioner,
or some other City official whom the Mayor shall designate, who shall forthwith inspect or cause
to be inspected the premises and shall make a written report of his findings to the Mayor.
Whenever practicable, the inspection officer shall cause photographs to be made of the premises
and shall file the same in the office of the City Clerk -Treasurer. (Carmel City Code, § 12.03 (a),
1979)
(b) SUMMARY ABATEMENT.
(1) NOTICE To OWNER. If the inspection officer shall determine that a public nuisance
exists on private property and that there is a great and immediate danger to the public
health, safety, peace, morals or decency, the Mayor may direct the Chief of Police, or a
deputy sheriff, to serve a notice on the owner, or, if the owner cannot be found, on the
occupant or person causing, permitting or maintaining such nuisance and to post a copy of
the notice on the premises. Such notice shall direct the owner, occupant or person causing,
permitting or maintaining such nuisance to abate or remove such nuisance within 24 hours
and shall state that unless such nuisance is so abated, the City will cause the same to be
abated and will charge the cost thereof to the owner, occupant or person causing, permitting
or maintaining the same, as the case may be. (Carmel City Code, § 12.03 (b), 1979)
(2) ABATEMENT BY Cr Y. If the nuisance is not abated within the time provided or
if the owner, occupant or person causing the nuisance cannot be found, the Building
Commissioner, or some other City official whom the Mayor shall designate, shall cause the
abatement or removal of such public nuisance.
(c) ABATEMENT BY COURT AcnoN. If the inspecting officer shall determine that a public
nuisance exists on private premises but that the nature of such nuisance is not such as to threaten
great and immediate danger to the public health, safety, peace, morals or decency, he shall file
a written report of his findings with the Mayor, who shall cause an action to abate such nuisance
to be commenced in the name of the City. (Carmel City Code, § 12.03 (c), 1979)

In addition to any other penalty imposed by this Chapter for the erection, contrivance, creation,
continuance or maintenance of a public nuisance, the cost of abating a public nuisance by the
City shall be collected as a debt from the owner, occupant or person causing, permitting or
maintaining the nuisance, and if notice to abate the nuisance has been given to the owner, such
cost shall be assessed against the real estate as other special taxes. (Carmel City Code, § 12.04,
1979)
m I.C. 34-1.52-2(b), authorizes the City Attorney to bring an action to abate or enjoin a nuisance. I.C. 34-1-52.5-
l(d) defines the City Attorney as the "prosecuting official' and pursuant to I.C., 34-1-52.5-3 authorizes him to
bring an action to abate indecent nuisances, to perpetually enjoin the maintenance thereof; and to recover
reasonable attorney fees.

Chief Tim Green. Graham was going to speak with Graverson about the placement of the

It seems to be one thing after another doesn't it, here in "dogpatch?" Anyway, I was already aware of these new
problems; I stumbled across them while checking to see if the dumpster was gone. I have contacted the
Carmel Police Department about the trash in the street; I am hoping that they can use their ticketing powers
to have that removed from the public right-of-way. I have not heard anything back from them, so I am assuming
at this point they will take care of it.
As for the grading, I sent an inspector from the Engineer's office to check it out and make some
suggestions. Apparently the re -grading in the back yard was to make it easier to mow down by that ditch. This is
fine; however the city has some concerns that the exposed soil will erode into the ditch. I suggested to Graverson
that he put straw bales along the ditch to slow the velocity of water. Then in the spring when it is suitable to grow
seed, the bales can be broken open and used as mulch over the seed. Graverson agreed this was a good idea
and has committed to do this.

Sorry to bug you again. I do have good news though - the dumpster is gonel And, as a side benefit, Mr.
Graverson provided holiday entertainment for my relatives from out of town as he climbed into the
dumpster and started throwing stuff out into the street. The flipside is that my sister from Baltimore now
jokingly refers to Carmel as "dogpatch". Its probably a good thing she saw it before they started
"landscaping" with the small front-end loader that is currently parked in the driveway.
In any case, I figured the trash in the street would be dealt with shortly, but it has been a few weeks,
and once again I, unfortunately, feel compelled to whine about it. I imagine it is probably not legal to throw
garbage into public thoroughfares, though I don't know for sure.
I have attached a couple pics (taken before the dumpster left)

He will not have any luck with grass this time of year. He can stagger some straw bales against both the edges of the
paved ditch to slow down the velocity of water during possible storms. This will offer some protection to the exposed top
soil. The area will have to be regaded in the spring when it is favorable to get grass to grow. He could then break open
the bales and use the straw for mulch in the seeded areas.

I took some pictures of the excavated area along the paved side ditch. The property owner has cut back dirt
along the edges of the side ditch to, I would assume, make it easier to cut the grass. The existing grass and top
soil has been scalped down to the same level as the top of the paved side ditch. The problem will be preventing
dirt erosion along the sides of the paved ditch and possibly in some areas under mining dirt from under the ditch
and causing sections of the ditch to settle. Let me know how I can help you.

Can you go take a look at the re -grading that has been done at 12933 Wembly Court (Lot 184, Brookshire
North)? I was out there on an unrelated matter and found some re -grading had occurred in the back yard. I
am sure there is easement involved, as there is a concrete -lined ditch that runs across the back of most of
those properties. I have seen this area flood in the past, so I would imagine this ditch is an integral part of the
drainage system in the area. This house backs up to Gray road and can be easily viewed from Gray just
south of 131 st Street. Let me know what you think. I have some other business to discuss with this property
owner and can address this with him as well.
