Elliot �� Mohawk Place Center 620 A South Range Line Road Carmel, Indiana 46032 RE: ZONING ORDINANCE VIOLATION —ACCESSORY STRUCTURE Dear Mr. Elliot: On August 21, 2003 Mr. Hollibaugh, Department of Community Services Director, sent you a letter at your request explaining the regulations which applied for the barn shown in Exhibit A. The letter specifically addressed accessory structure setbacks in addition to temporary signage. Obviously you were in receipt in that letter, as the temporary signage violation no longer exists; however the accessory structure is still being displayed illegally. In this situation, the Zoning Ordinance does not differentiate whether the barn is a display ("for sale" display) or if it is a permanent placement as an accessory structure. As such, the barn is subject to all regulations that apply for an accessory structure. As Mr. Hollibaugh's letter indicated, accessory structures (as per §25.07.02-6.3.a of the Carmel/ Clay Zoning Ordinance) must be setback at least twenty-five feet behind the building setback line or twenty-five feet behind the front of the building, whichever is greater. Currently the barn does not meet these setbacks as Exhibit A illustrates. Please move the accessory structure behind the designated setback line by March 2, 2004 to avoid further enforcement action. First of all, you must decide whether this storage barn structure is a product display or an accessory building. The storage barn display did not need a building permit, but it still must comply with the requirements of an accessory building of the Zoning ordinance, if you are deciding it to be an accessory building. Per Section 25.07.02-B.3.a (Minimum front yard setback), an accessory building must be set back a minimum of the greater of the following: a. Twenty-five feet behind the Front Line of Building; or b. Twenty-five feet behind the Building Setback Line If the structure were considered a display, it would still be considered an accessory (display) structure. If the location of the storage barn must be in front of the Front Building Line, you can apply for a variance, and the petition will be heard before the Board of Zoning Appeals. I will gladly fax you an application, or they can be picked up in our office. Your tenant was denied a sign permit because the sign type is prohibited per Section 25.07.01-04f of our Zoning Ordinance: (Prohibited Signs) 'T Signs consisting of banners, posters, pennants, ribbons, streamers, strings of light bulbs, spinners or similar devices...." If the structure is considered an accessory building, any sign at all would not be allowed because a business is not operating out of the structure. If the structure is a product being displayed, then, again, no sign is allowed. If you do not agree with the interpretations stated above, you can appeal the decision of the director before the Board of Zoning Appeals. Again, applications are in our office. The tenant applied for a building permit and was told that none was needed for the size of the buidling. The tenant was also told that the building should be twenty-five feet back from the street, which he is now in the act of complying. I feel that my tenants are being treated unfairly, because of other sign permits that have been issed that are comparable. I have contacted legal counsel and he asks for a signed hand written letter stating why a sign permit will not be issued. Please submit this letter to me, the Mohawk Place Center owner.
