(a) Adoption by reference: LC., 36-7-9 et seq., as amended from time to time, which addresses unsafe buildings and the enforcement of building standards, is hereby adopted and incorporated in full by this reference, and is supplemented by the additional terms and conditions of this section. (b) Definitions. City shall refer to the City of Carmel, Indiana. Department shall refento the Department of Community Services. Director shall refer to the Director of the Department of Community Services. Hearing Authority shall refer to theCarmel Board of Public Works and Safety. Mayor shall mean the City Executive and the head of the Executive Branch of the City's government. Substantial Property Interest -shall refer to any right in real property that may be affected in a substantial way by actions authorized'. hereunder, including a fee interest, a life estate • interest, a future interest, a present possessory interest and/or the equitable interest of a contract purchaser. Unsafe Premises shall refer to;an "unsafe building," as defined hereinbelow, and the tract of real property on which the unsafe building is located. (c) Nuisance. All buildings or portions thereof within the City which are determined after inspection by the Director to be "unsafe"'as defined in subsectiom(h) herembelow, are hereby declared to be public nuisancesand shall be abated by repair, rehabilitation,,demolition, or removal in accordance with the terms and conditions of this section. (d) Authorized official. The Director shall be authorized to administer and enforce this section and to proceed under the provisions hereof in ordering the repair, removal or other disposition of any building or structure.found to be "unsafe." (e) Nearing. Any hearing required pursuant to such order shall comply with LC., 36-7-9-7. (f) Action performed.by contractor. Pursuant to LC., 36-7-9-10 and 36-7-9-1 1, the Mayor may cause any action required.by an order of the Director hereunder to be performed by a contractor. (g) Authority to determine compliance. Any provision hereof -which provides for the • approval or direction of the Director, or any other officer of the City, shall be construed as giving such person only the discretion to determine whether compliance with the rules and standards established by this section have,occurred, and not as giving such person any discretionary powers as -,to the substance of such rules and standards, nor any 'power to=require: conditions not prescribed by this section„nor any power to enforce these section provisions in an arbitrary or •' discriminatory manner. (h) Unsafe. building; defined. An Unsafe Building under this section shall be any building or structure, or any part of a building or structure, that: (1) Is, in an impaired structural condition that makes it unsafe, to a person or property; (2) Is afire hazard; (3) Is -a hazard to the public health; (4) Is a public nuisance; (5) Is dangerous to a person or property because of a violation of a statute or ordinance concerning building condition or maintenance; (6) Is vacant and.not,maintained in a manner that would allow human habitation, occupancy or use under the requirements of any statute or ordinance; (7) Has any door, aisle„passageway or other means of exit that is not of sufficient width or size or is not arranged so as to provide safe and adequate means of exit in case of fire or panic; • (8) Has the walking surface of any aisle, passageway, stairway ovother means of exit so warped, worn, loose or otherwise: unsafe so as not to provide safe and adequate means of exit in case of fire or panic; (9) Has stress on any material,. member or portion thereof, due to dead and/or live loads, that is more than one and one-halftimes the working stress allowed for new buildings of similar structure, purpose or location; (10) Has any portion'thereof that has been damaged by fire, earthquake, wind, flood or other cause to such an extent thatthe structural strength or stability thereof is materially less than it was before such event and is less than the minimum requirements for new buildings of similar structure, purpose, or location; (11) Has any portion, member or appurtenance thereof that is reasonably likely to fail, to become detached or dislodged or to collapse and thereby injure persons or damage property; (12) Has any exterior. portion, member, appurtenance or ornamentation thereon that is not of, sufficient, strength orstability,,oris not anchored„attacned,or fastened, so as,to be,capable of resisting a wind pressure of one-half of that specified.for new buildings of similar structure, purpose, or location without exceeding the working stresses permitted for such buildings; (13) Has any portion thereof that was warped, buckled or settled to such an extent that • walls onother structural portions have materially less resistance to winds or earthquakes than is required in the case of new buildings of similar structure; purpose or location; (14) Is, or has any portion thereof that, because of (1) dilapidation, deterioration, or decay; (2) faulty construction; (3) the removal, movement, or instability of any portion of the • ground necessary for the support of such building; (4) the deterioration, decay, or inadequacy of its foundation; or; (5)'any other cause, is reasonably likely to partially or completely collapse; (15) Is, or has any portion thereof that is, manifestly unsafe"for the purpose for which it is being used; (16) Has exterior walls or other vertical structural members that list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle one-third of the base; (17) Shows, exclusive,of its foundation, 33% or more damage or deterioration of any supporting member, or 50% or more damage or deterioration of any non -supporting member, enclosure or outside wall or covering; (18) Has been so damaged by fire, wind, earthquake or fiood.or has,become so dilapidated or deteriorated so as to become (I) an attractive nuisance to children, or (2) freely accessible to persons for the purpose of committing unlawful acts; (19) Has been constructed,. exists or is maintained in violation of any specific requirement or prohibition applicable'to:such building or structure provided by any law of the State of Indiana or any City ordinance or building regulation relating to the condition, location or structure of buildings; • (20) Has, whether or not -it was erected in,accordance with all applicable laws and ordinances, in any non -supporting part, member or portion, less than 50%, or in any supporting part, member, or portion, less than 66%, of the (1) strength, (2) fire -resisting qualities or characteristics, and/or (3) weather-resisting„qualities or characteristics that would be required by law in the case of a newly constructed building thereat of like area, height and occupancy; (21) Is used or intended to be used for dwelling purposes and, because of -inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the Hamilton County Board of Health to be unsanitary, unfit for human habitation or in such a condition that it is likely to cause sickness or disease; (22) Is, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits or lack of sufficient fire -resistive. construction, determined by the Carmel Fire Department to be a fire hazard; (23) Is the remnant of a.building or structure that remains on site after the attempted demolition or'destruction-of such building or structure; or (24) Is abandoned for a period in excess of six months, so as to constitute an attractive nuisance or hazard to the public. (i) Work performed in.work-manlike manner. All work for the, reconstruction, repair, or demolition of buildings and other structures performed pursuant hereto shall be performed in a good and workmanlike manner according to accepted standards and practices in the trade. The provisions of,all building laws'.referenced in LC., 22-12-1-3, as adopted as rules of the Fire •' Prevention and Building Safety Commission described in LC.,,22-12-1-6, shall be considered standard and acceptable practices for all matters covered hereby and/or all orders' issued by the Director pursuant hereto. 0) Unsafe Building Fund. An.Unsafe Building Fund is hereby established in the operating budget of the City in accordance'with the provisions of i.C., 36-7-9-14. (k) Construction and the likeforbidden. No person, firm, corporation or other entity, whetheras owner, lessee, sublessee, or occupant, shall erect, construct, enlarge, alter, repair, move, improve, remove, demolish, equip, use, occupy or maintain any building or premises,..or cause or permit the same to bCdone, contrary to or in violation of any of theprovisions of this section and/or any order issued by the Director hereunder. (1) Violation. Any violation of the provisions of this section shall` constitute a Class C Infraction for each day such violation continues, except where another -penalty is expressly set forth in I. C., 36-7-9 et seq. (m) Performance bond. The Carmel Board of Public Works and Safety shall, aftecproper notice and hearing, adopt a schedule setting forth the maximum amount of performance bonds applicable to various types of actions ordered by the Director hereunder and'the amount of the average processing expense incurred;m taking the actions necessary hereunder concerning a typical unsafe premises. 10 (n) Severability. Should any section, paragraph, sentence, clause, or phrase of this section be declared unconstitutional, or invalid for any reason by a court.of competent jurisdiction, the remainder of this section shall continue in full force and effect and'not be affected thereby. After further review of the documents you provided, the Department has determined that you have a few options by which you can rectify the violation. Based upon Department policies, your options are listed below in order of most desirable. 1. Replat your parcels into one building -lot. This action would consolidate the parcels and thereby remove the lot lines (and required setbacks) that run down the middle and across the rear of the properties you own: Thiswould be an administrative approval within the • Department of Community' Services. ' 2. Move the fence to within the buildable area of your existing properties. Required setbacks would be 20 feet from the rear property line and 10 feet from the sides. 3. Shorten the fence in its existing location to meet the height requirement of 6 feet. 4. Seek a Variance to allow a fence taller than allowed in the required rear and side yards. This petition would be a publichearing before the Carmel/Clay Board of Zoning Appeals. Please weigh these options and keep, the Department informed of any decision and/or changes you make to the fence. We do ask however that you let us know of your decision within 10 days. Scott Brewer, Urban Forester and Adrienne Keeling, Code Enforcement Inspector represented the city. We carefully reviewed the landscape plans with the following conclusions, 1. Seventeen (17) trees are missing 2. Fourteen (14) trees are dead 3. A number of other trees are not planted properly (plastic twine and top burlap not removed) which will cause these trees to die. A color coded copy of the plans indicating the missing and dead trees is enclosed. The remaining trees will have to be inspected to determine if they were planted properly. Our homeowners association has tried numerous times to get these issues resolved. We were excited and pleased to see the additional planting last year only to be dissapointed by the results of our inventory of the plantings and improper planting. Scott conducted a final site inspection last July. A letter was sent to Corby Thompson requesting resolution of the problems. Scott's letter was not responded to and resolution has not occurred. Scott also mentioned in his letter that a re -inspection would be necessary. We are sending a copy of this letter to Corby Thompson to make sure he is aware of this situation. Unfortunately we do not have an extra set of plans to attach to his copy. I am hopeful that together you and Mr. Thompson will resolve these issues in a timely manner. Our association respectfully requests a written response to this request by the end of this month, to include resolution and timing. We further resent the fact that he uses "we" in his letter, thus turning his views -into ours. We clearly do not agree with and do not share his views. Many of us are worried that due to one person, Plum Creek Golf Course, is being asked to institute changes.that will, increase the cost of doing business for the golf course and will be reflected in the cost of playing golf. Indirectly, this will result in lowering the value of our homes. We believe that early morning maintenance is important for the following reasons: A. To maintain safety of the people working on the course. B. To maintain safety of people playing on,the course. C. To expedite.play (maintenance personnel on the course affects this). D. To maintain.the "current cost of golf fees. The Plum Creek Golf Course was here before any homes were built. We doubt if Mr. Berry failed to see the course when he purchased his home. Maintenance -on the golf course was done in.the early morning:at the time all of us purchased our homes. We all knew when'we purchased our homes that this is normal operating procedure on all golf courses for the reasons stated.above. Mr. Berry purchased a home onPlum Creek Golf Course, and he has enjoyed a higher property appreciation rate than his neighbors who do not live directly on the course: The appreciation of his home.speaks very highly of the care given to.Plum Creek Golf Course. Our course, because;of its excellent condition, was selected to host the Indiana Amateur tournament in 2002 and to host the PGA Indiana Open Golf Championship in 2003.' The PGA committee and both the golf professional and amateur players that played our,course raved about•the friendliness of the personnel and the wonderful conditions of the course. r As for the "unattractive appearance of the golf course",there are -always places that need improvement. Furthermore, the "2YZ foot high brown grass is considered part of the normal links course designed by Pete Dye in the Scottish tradition. This feature adds character to the course, was part of the original design, and should not be changed. Residents of Carmel should be proud of Plum Creek Golf Course! We think that the board should in fact reconsider any restraining order for early morning maintenance on all golf courses. Plus, one sees a lot more walking or jogging than driving. The unburied cable is the respoonsibility, probably, of Brighthouse. It may be out of place due to bridge construction work,. which is the responsibility of Hamilton County (counties are responsible for all bridges within the county regardless of whether they are in the city limits). Ameritech, I think, blew you off. I will have the appropriate city officials contact them. The adiacent property owner has responsibility for removing debris from their property which adjoins a creek. Unofrtunately, I am way too familiar with that rule since I had to pay to have 13 triaxles of debris removed from our property last year when a large treee fell. If the debris has accumulated in the area that adjoins the city right-of-way, we will take care of it. We have processes in place totake care of each of these items and I have forwarded copies of your e-mail to Adrienne Keeling, our code enforcement officer and Kate Weese, P.E., our city engineer. (2) AMERITECH TERMINAL POST: There is an underground cable Terminal .Post in the,middle of a.concrete sidewalk along Cheswick Blvd. The item ;s.Ameritech's.standard, 8" x 8" x 3'0" high post that is usually in the property lawn,. but in this case it is embedded in the concrete sidewalk. The drainage swale work cut and removed most of the roots on the east side.of;the tree, leaving the tree with hardly any fuctioning root System 'at all. 6. The extreme amount of recent rainfall was perhaps the "last straw" for the tree. It would.be my recommendation.the tree.should'be,removed as soon as reasonably possible. Adding to the other factors are that the fact the tree has internal�column of decay (it's at least partialy'hollow), and a company has started to remove the lower major branches. Mrs. Mahoney claimed that Mr.. Padjen had agreed to help cover the removal cost at the,time of the drainage work,;if the tree.laterneeded to be removed. I would say that seems like a very fair offer, since his backyard construction projectdisturbed the western root system, and the,drainage project that cut the other half of the: root system was also needed because the same backyard construction caused a change in drainage that had to be corrected. The ddg,never stops barking not even for a moment_ We reported this neighbor to our association, and he told the property manager that he's out of town every weekend and that the dog remains, looked up inside the home during these days. There are some areas that probably should be brought into compliance with current constitutional law. For.example, the Carmel regulations do not appear to address political signs ofa non -election nature in any way. Additionally, durational regulations for political signs have generally been held to be unconstitutional. City of Ladue v. Gilleo, 114'S. Ct. 2038"(1994); Painesville Bldg. Dept. v. Dworken & Bernstein Co., L.P.A:, 733 N.E.2d 1152 (2000). One thing courts look to in;challenges'to such regulations, is whether 0 temporary signs are treated similarly:. Most: of the.types of temporary signs in the Carmel regulations have durational requirements. However,,I noticed that there is no such requirement with respect to temporary real estate signs. ...: Additionally, prohibiting non -point of sale advertising, as the Carmel regulations attempt to do, has been declared unconstitutional;in Ohio. Norton Outdoor Advertising, Inc. v. Village of Arlington Heights, 433 N.E.2d 198'(1982). Obviously, any changes to the sign ordinance could not be adopted prior to your codification deadline.
