HomeMy WebLinkAboutBPW-06-15-11-01 Excess Sick Leave Buyback RESOLUTION BPW 06- 15 -11 -01 2811 JUN 8 P 12: 1 8 A RESOLUTION AUTHORIZING THE BUYBACK OF EXCESS SICK LEAVE FROM CIVILIAN EMPLOYEES OF THE CITY OF CARMEL WHEREAS, the City of Carmel grants each civilian employee a generous allotment of paid time off (PTO) each year, with excess time transferred to the employee's Sick Leave Bank at the end of each benefit year; and WHEREAS, each civilian employee is permitted to carry over up to 300 hours in his /her Sick Leave Bank from one benefit year to the next; and WHEREAS, the use of such sick leave, even when necessary and approved, can have a significant and disruptive impact on City operations; and WHEREAS, the City wishes to encourage employees to use sick leave only as necessary, and to reward those employees who demonstrate exemplary attendance; and WHEREAS, the Carmel Common Council authorized the discretionary buyback of sick leave through Ordinance D- 1939 -09; and WHEREAS, the money to fund a buyback is included in the 2011 budget. NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Board of Public Works and Safety as follows: A discretionary buyback of unused sick leave is authorized in 2011, according to the terms outlined below. 1. All sick leave buybacks shall be based upon the balance in an employee's Sick Leave Bank as of June 24, 2011 (including any amount transferred from the employee's PTO Bank to his /her Sick Leave Bank effective June 24, 2011). 2.a. Any employee who has a balance between 225 hours and 300 hours in his /her Sick Leave Bank as of June 24, 2011, may elect to have the City buy back any or all of the sick leave in excess of 225 hours. Each eligible employee will be required to file an election form indicating the number of hours to be bought back and the number of hours to be retained. Any employee who fails to complete an election form on a timely basis shall retain all time in his /her Sick Leave Bank up to and including 300 hours. 2.b. The City shall buy back all time in excess of 300 hours in any employee's Sick Leave Bank as of June 24, 2011. No employee will be allowed to carry over more than 300 hours of sick leave from one benefit year to the next. 3. Sick leave shall be bought back at a ratio of one (1) hour of pay for each two (2) hours of eligible leave. 4. The rate of pay for the buyback shall be the employee's standard hourly pay rate at the time the payment is issued. 5. Buyback payments shall be made by the City no later than July 29, 2011. 6. The City will conduct only one sick leave buyback in 2011. An employee's decision regarding the buyback of his /her unused sick leave, as stated on his /her written election form, or, absent the timely submission of an election form, the terms of this Resolution as regards the buyback of sick leave, shall be final and binding.
