You should have received a Department Report for this item yesterday via e -mail. We are in agreement with DOCS and recognize the plans on file comply with the applicable requirements of the Zoning Ordinance. Likewise, this matter comes back to the Plan Commission with a favorable recommendation from the Subdivision Committee. We recognize that this is a challenging site on the edge of the US 31 Overlay Corridor and we have made significant efforts to date to ensure that the plan meets the Ordinance. Over that last few days we have received additional input from Plan Commission Members in particular Brad Grabow (the Committee Chair who reviewed this item). Brad encouraged us to take another look at the plans to see if there were areas where we could make adjustments which would go further in addressing the concerns raised by the neighbors. In that regard and in response to the recommendations received the applicant has made the following additional modifications which are reflected in the attached exhibits. 1. Revision to the east parapet screen profile to reduce the mass and effective height necessary to screen rooftop mounted equipment. The parapet screen along the east perimeter of the building is now approximately 9' lower than the plans previously submitted. The modification can be seen in (i) the building cross section, (ii) the elevation, and (iii) the perspective view all of which are attached to this e -mail. The modified parapet will still effectively screen rooftop mounted equipment while being less of a design feature embellished with dormers and other design elements drawing attention to the top of the building. 2. The Applicant commits to work with the adjacent neighbors to relocate as many as three (3) trees per adjacent lot to a location of the adjoining lot owners choosing within the 50' buffer area. The relocated trees will be those added by the applicant adjacent to the east side of the building above and beyond the Ordinance requirements. If the adjacent owner does not desire the trees moved to an alternative location the applicant will still plant the additional trees along the area identified on the plans. The attached exhibit entitled Landscape movement illustrates the location of the trees and potential relocation. 3. The applicant will commit to construct an asphalt path along the frontage of Smokey Row Road and Old Meridian Street to connect the development to the pathway entrance to Meadowlark Park. This off site improvement will also, by its construction and the path construction across our frontage, connect the Kensington Place neighbors to the park and public pathway infrastructure which it lacks today. The attached exhibit entitled off site path illustrates the path location and entrance to the park. We acknowledge that these additional changes are not required to satisfy the requirements of the Zoning Ordinance but feel that it is necessary for the applicant to be as responsive as possible to the concerns raised by the neighbors while still maintaining the quality and integrity of a proposal that meets the standards of the Ordinance.
