On May 15, 1973, we directed to your Board a letter out-
lining our willingness to cooperate in certain respects
with the sewer line extensions running north from your
existing sewage treatment plant at 96th Street. While
we have had occasional contacts with your engineering
representatives, we are uncertain as to the exact status
of this project. We would appreciate receiving in-
formation on the exact alignment of this sewer line.
Does your Board desire to accept our offer of certain
lands and rights of way as offered in our May 15th letter?

A copy of your letter tras directed to me today and I must apologize for
the apparent lapse of communication between us.
I wish to assure you that we are definitely interested in accepting your
offer of certain lands and right of way, and design engineering is
rapidly nearing completion by our consultant, Clyde E. VTilh iasm Assoc.
I am sending you, under separate cover, a set of the plans.for our Phase I
proposed construction. Note that the area map has a red line marked on it.
This is future Phase II routing. I am also sending a copy of the proposed
R/U descriptions which cover both Phase I and Phase II.
Our Town attorney is preparing the legal easement dedications to be
presented to you very shottly.
I will reccommend that the Town Board take official action to accept your
offer at the next regular meeting of the Board of Trustees.
Your co- operation is very much appreciated, and I hope this will
satisfy your immediate requirements for information.

Reference is made to a meeting held May 1, 1973, in our 96th
Street plant office, such meeting being attended by repre-
sentatives of your Board, by your consulting engineers and
by representatives of our corporation. An adjoining landowner,
Mr. Erich Mueller, was also present.
At this meeting your representatives outlined for us that a
new sewer line must be installed promptly running northerly
from your present waste water treatment plant on North River
Road, and that such new sewer line could take two possible
alignments, namely:
A It could run north along North River Road to
106th Street, thence east and north again along
North River Road to 116th Street. A lateral
connector would run west along 106th Street to
relieve an overloaded line located farther west.
B It could run east from River Road along the north
boundary of your treatment plant and thence northerly
along the White River until it joined North River
Road north of 106th Street. A similar lateral
connector would be installed running westward along
106th Street.
Both we and the owner immediately north of us, Mr. Erich Mueller,
indicated we favored the "river" alignment. Your engineers
indicated that, while the river alignment might be the desirable
route when the entire project was considered, it appeared from
their preliminary estimate of construction cost to be more costly
for the initial section to 106th Street and this was the immediate

problem you faced.

Subsequent to the above referenced meeting, we contacted your
engineering consultant, Mr. Herb Zinsmeister of Clyde E.
Williams Associates, and outlined that we saw the probability
of substantial damages to our mining operations if the North
River Road alignment were used. As an inducement for you to
select the "river" alignment, we expressed our willingness to
do a number of things and these items are hereby confirmed:
A We are willing to have the line proceed from
a point in North River Road at the north edge
of your treatment property, and thence north-
east 45 degrees from North River Road until it
reaches the desired distance from the White River,
and thence northerly across our property in a
north northeast direction until it enters property
owned by Mr. Mueller. North of 106th Street and
south of 116th Street we are willing to allow the
alignment to proceed generally along the section
line. Where this entire alignment traverses property
owned by this corporation, we are willing to give a
reasonable width of permanent sewer easement and
a reasonable width of construction easement to
the Town of Carmel at no cost.
B We are also willing to deed a triangular- shaped
parcel of land estimated to contain 8.6 acres,
located immediately north of your present treat-
ment plant, to the Town of Carmel at no cost. This
would provide added land for expansion of your waste
water treatment plant. The northwest boundary of
this triangular- shaped parcel would be the northwest
edge of the 45 degree sewer line easement mentioned
above.
C If needed, we would be willing to advance on a
temporary basis to the Town of Carmel up to fifteen
percent (15 of the added cost, if any, of the
initial phase of the work to 106th Street caused by
using the "river" alignment as opposed to the North
River Road alignment. Such sum to be advanced would
not exceed thirty thousand dollars ($30,000), and
would be refunded to us either in cash or credited

to our account to offset future trunkline sewer
charges applying to our lands in the area.
Our willingness to do the above three items is specifically
conditioned on your selecting the so- called "river" alignment.
None of the above items would be applicable should you choose
the North River Road alignment which will cause substantial
damages to our operations.
In granting the permanent easement for this sewer line along the
"river" alignment, we would agree that our quarrying operations
would be kept a sufficient distance away from the actual sewer
line that the vibration, measured at the sewer line itself,
would not at any time exceed two inches per second of particle
velocity, a figure given by public authorities as safe for
structures. (See Bureau of Mines Bulletin #656.)
We hope the above accurately confirms the verbal proposals made
to your engineering representatives, and that you conclude the
"river "alignment is the most advantageous to the Town of Carmel
when all factors are considered.

Dear Leroy:
Pursuant to our recent telephone conversation, I am providing
you with a written memo informing you that our corporation is
willing to cooperate with the Carmel -Clay Community to the
extent of providing a place to dispose of sludge from the
River Road sanitary station. I might suggest that someone
from the sanitary department get in touch with us in order to
firm up the location and haul road.
As you know, we are trying our best to be an asset to the
community, and do desire to remain a vital factor in that area
for many years.
At some time in the future I would like to get together with
you in order to discuss the possibility of American Aggregate
being a prime source of raw water for Carmel. I feel that we
can provide the communi with a sufficent supply of raw water
at a very low cost. If this sounds interesting let me know.

3. The deposit will at all times be in conformance
with the applicable laws and ordinances as to
public health and sanitation.

Aggregates Corporation and the town will abide by
his instructions as to placement of such sludge

4. The Indiana manager for American Aggregates Corporation
will from time to time direct alternate locations
when convenient or desirable to the corporation, and
the deposits will be made in such manner and under
such practices as will not be offensive to the
corporation or the area or surrounding owners.
This permission will extend fora period of two years from the
date of this letter, and will be subject to renewal at the
option of the town and the corporation at the end of said time.

The corporation shall have the right to terminate this
permission at any time that the deposit of sludge is not
performed in accordance with its instruction and at any
time that said deposit becomes a hazard to health or becomes
offensive in the use of the corporation's other adjoining
land or to adjoining landowners or residents.

It is hereby resolved by the Board of Trustees of the
Town of Carmel that disposal of sludge from the Carmel-Clay
Wastewater Plant, located at 96th Street and White River in Hamilton
County, be accomplished on an interim basis by controlled spreading
on American Aggregates properties in the vicinity of the Plant,
with such locations and the method approved by the Indiana State
Board of Health and the Indiana Stream Pollution Control Board;
And be it further resolved, 'that by late 1973, the above
described method of sludge disposal will be discontinued, and an
approved form of sludge de-watering will lie implemented at the
plant site and acceptable sludge disposal sites will be provided
with such sludge de-watering process to be continued until comple-
tion of construction of the plant expansion to 3.0 MGD capacity,
which shall include permanent on-site sludge disposal facilities.

serve to indicate our interest in the construction of an
interceptor sewer from 126th Street to the sewage plant on
96th Street,
As we discussed at the December meeting a mutual interest
does exist. If after an investigation, in regard to cost
and alignment, is completed I would appreciate an opportunity
to again discuss this matter with you.
