DEDICATION OF STREET
The undersigned, LEWIS C. BOSE, TRUSTEE, LANDMARK DEVELOP-
MENT CO., an Indiana limited partnership, both of Hamilton County,
Indiana, RALPH L. WILFONG, a resident of Hancock County, Indiana,
and STEAK n SHAKE, INC. a Delaware corporation, hereby dedicate
to the public for a street, certain -real estate situated in
Hamilton County, Indiana (the "Dedicated Real Estate a
description and plat of which are attached hereto as Exhibits
"A" and "B respectively.
By executing and causing this Dedication to be recorded, the
undersigned represent and warrant as follows:
1. They are, collectively, the owners of the Dedicated Real
Estate, subject only to the rights -of -way of Westfield Boulevard
and State .Road 431, and certain utility easements.
2. The Dedicated Real Estate is generally known as Carmel
Drive, and is located in the Town of Carmel, Indiana.
3. This Dedication is made in connection with a sale by
Lewis C. Bose, Trustee, of certain of this real estate and is
intended, without limiting the generality thereof, to be
irrevocable, and to provide public access to such real estate and
to all of the real estate abutting on the Dedicated Real Estate.
Mildred H. Wilfong is signing this Dedication as the
wife of Ralph L. Wilfong for the purpose of subjecting
to the Dedication made herein whatever rights she has in the
Dedicated Real Estate.
