Ni r x x �s r i s The applicant seeks approval to create 3 z; x ri S residential lots that are y k+ t� E :ty„z, v F r mow r %.�j e each 45 -ft wide; the L rte .k ay �T i r Y, T ma r 1 Old Town Overlay ordinance requires 50 -ft. The variance is for a 5 foot deviation. The petitioner will also seek Plan Commission Primary Plat approval a Subdivision Control Ordinance Waiver to create these 3 lots. Also, the petitioner will have to submit Site Plan Design (SDR) review applications to the Department, who will review and approve the architectural building elevations and site plans to make sure each house/garage meets the requirements of the Character Subarea of the Old Town Overlay. Please see the petitioner's informational packet for more detail. Findings of Fact: 1. The approval of these variances will not be injurious to the public health, safety, morals, and general welfare of the community because: this will be a great redevelopment project for Old Town, and will help add to the character of the area and bring back the original layout of houses on long, narrow lots. The 5 -ft variance will help accomplish this. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: this will be a great redevelopment project for Old Town, and will help add to the character of the area. The 5 -ft variance will help accomplish this. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: a different layout will have to be utilized on the parcel and might not be as aesthetically pleasing. Recommendation: After all concerns have been addressed, the Dept. of Community Services recommends positive consideration of Docket Nos. 11060005 V.
