Re: Schneider Office Park, 10321 Pennsylvania Street building setbacks
Pursuant to the Carmel Zoning Ordinance, the referenced property is located in both the
Carmel B -7 Business Zone, and the West Home Place Commercial Corridor Zone
Districts (Low Intensity). Copies of ordinance language for each district are attached.
Although both Zones specify setback standards for front yards, rear and side yards, in
situations where the setback standards conflict, the Zoning Ordinance defers to the
Overlay Zone standards, per Section 23E.02.4.
The specific setback standards in the West Home Place Commercial Corridor Zone are:
Front Yard: Five (5) feet
Side Yard: Ten (10) feet
Rear Yard: Fifteen (15) feet, when adjacent to existing residences
Ten (10) feet, when adjacent to existing business
While the building at 10321 Penn St. has been built to an approximate thirty (30) foot
rear yard setback, the Overlay Zone will allow for any future buildings to be
constructed on the site to located up to fifteen (15) feet from the rear property line,
provided any adjustment allows for substantial compliance with the approved
development plan, and all landscape and buffering requirements are also fulfilled.
