CORPORATION STATUS REASONS FOR BUILDING PERMIT TO BE DENIED: It is the opinion of the Thornhurst Neighbors that the erection of the proposed structure submitted as part of building permit #11010015 (carport type structure) would be a visual detriment to the neighborhood. We as neighbors understand the property owner is entitled to erect a structure of some type on his property. However, the Thornhurst Neighbors believe that the proposed structure submitted as building permit 11010015 fails to meet the quality of standard established by the City of Carmel or the intent of the ordinances that are meant to protect property owners. It is also the opinion that the property owner did not obtain the necessary variances that are needed to erect such structure on his property. The City of Carmel Department of Community Services (DOCS) Building Code failed to research the permit for accuracy in regards to the following sections. 1. Chapter 25 Sec 25.01.01.A.1 Accessory Building: Residential Districts. '1. Accessory Buildings and Uses shall not alter or change the character of the premises' 2. Chapter 25 Sec 25.18.01.B.1,2 3 Home Occupation Standards Generally. 'B. Character: 1. The Home Occupation shall not change the character of the Dwelling, Lot or Parcel; 2. The Dwelling shall not bear any indication from the exterior that is being utilized in whole or in part for any purpose other than a Dwelling; 3. The Home Occupation shall not be permitted outside storage or display of materials in connection with the Home Occupation.' 3. 3. Chapter 25 Sec 25.26.O1.A B Commercial Vehicles. '25.26.01 Commercial Vehicles or trailers shall not be parked, stored maintained or kept on any residentially used or zoned lot unless the vehicle has a maximum load capacity of three quarter (3/4) of a ton or less; and A. Serves as the sole vehicular transportation of a resident of the property upon which it is parked, stored, maintained or kept; or B. Such vehicle is within a garage or carport which complies with all standards and regulations of this ordinance.' The City of Carmel Department of Community Services (DOCS) Building Code informed the property owner after numerous complaints that he is unable to store his commercial trailer or his recreational trailer on his driveway. The DOCS Building Code Services explained to the property owner that he had two (2) choices: either remove the trailer and store off-site or erect a carport type structure per the City of Carmel Ordinance- Chapter 25 Section 25.26- Commercial Vehicles. In January of 2011 the property owner submitted a building application to erect a carport. (see Tab 'C') In a letter from Mike Hollibaugh dated March 24, 2011 (a copy of the letter is included as part of the building permit- see Tab 'C') to all neighbors of Thornhurst Drive- including the property owner of 37 N. Guilford. Mr. Hollibaugh communicated that "any new accessory building shall not alter the residential character of the premises, and must be built so it does not create a visual detriment to adjacent property." It is of the opinion of the Thornhurst Neighbors that the proposed structure does not in fact match the character of the existing residence. The property owner to the south will look directly into the side of the proposed structure causing a direct visual detriment to his property. Thornhurst Addition consists mostly of one story post- modern and contemporary styled ranch homes and last year Thornhurst Addition- Section Two was placed on the National Historic Registry. Exterior building materials of homes located in Thornhurst Addition consists mainly of brick, stone, wood siding and one or two homes with vinyl siding. (See photos of 37 N. Guilford and surrounding homes -refer to aerial photo for address locations) The proposed carport as seen in the created photo image below consists of extruded aluminum panels with a metal frame structure. The aluminum panel color is to match the existing vinyl siding. The proposed height of the structure of 14' will be at the same height as the roof line over the garage. The structure itself does not match the architectural style and materials of the property owner's home or any of the surrounding homes. The proposed structure severely alters and changes the character of the existing premise. No other such structure exists in an R -2 zoning in the city limits of Carmel. The BZA requested the property owner to meet with staff and neighbors to resolve the appearance issue of the structure. Several items were discussed and the property owner has mentioned that he "could put a door on it" but no revised plans to date have been submitted to DOCS Building Code Services. The property owner indicated that he currently has the third highest assessed property in the neighborhood. He also stated that the Hamilton County Assessor's office indicated that the proposed structure would raise his assessed value. The home at 37 N. Guilford was erected in the year 2007, thus being one of the newer built houses in the Thornhurst Neighborhood. Newer construction will generally have a higher assessed value. Adding another structure to the property of course would increase the assessed value. After speaking with several realtors they indicated that assessed value does not reflect actual market value. One realtor provided the neighbors with a letter indicating the erection of such structure would in fact "de- value" the property. (see Tab 'D') The Thornhurst Neighborhood currently is an R -2 Residential District zoning. The Thornhurst Addition properties located along Guilford Road abutt the Old Meridian Overlay Zone. Immediately to the west and southwest the properties are zoned OM /MU —Old Meridian District /Mixed Use and or OM /MM- Old Meridian/ Mixed Medical (see Tab 'A'). The Old Meridian District Overlay Zone has strict architectural guidelines and material requirements. Across from 37 N. Guilford is an existing gas station. The gas station was constructured prior to the adoption of the Old Meridian Overlay Zone. Currently a gas station is not a permitted use, special use or even a special exception use. The existing use is currently grandfathered under the OM Overlay Zone. If in the future the gas station property is developed, the development shall look similar in appearance/ style to the development on the southwest corner of the Guilford Road and Main Street (see photo below) per the existing Old Meridian Street Overlay Zone. The proposed carport structure is not only a detriment to the Thornhurst Neighborhood due to lesser quality materials and architectural style but will also be visual eyesore to the Old Meridian Overlay Zone uses. The Thornhurst Neighbors are also questioning why a building permit was issued in the first place for a structure to house a trailer that exceeds the maximum weight capacity allowed? When DOCS Building Code Services informed the property owner that he had to erect a carport, at that time either the DOCS Building Code Services failed to discuss the intent of the ordinance section, discuss the issues of the maximum load capacity of the trailer or verify the maximum load capacity of the trailer with the property owner. The ordinance clearly states "vehicle" can be stored within a garage or carport not a trailer. Since the trailer in question is not the sole "vehicle" of transportation (the trailer is not motorized) and the ordinance does not say "vehicle and or trailer" can be stored in a carport. The trailer should not be allowed to be stored in any carport type structure. The trailer in question is used for the property owner's business as he has clearly stated in letters, emails and in person before the Board of Zoning Appeals. The property owner is currently running his business, Sierra Mobile Labs, Inc. from 37 N. Guilford Rd. The only known address currently for Sierra Mobile Labs is 37 N. Guilford Rd. The corporation status with the Indiana Secretary of State lists 37 N. Guilford Road as his entity address and such, is his "home base" to conduct all business transactions. (see Tab 'E') The property owner is "storing" his equipment (trailer) in an outside manner which clearly is prohibited under Chapter 25. Section 25.18- Home Occupation. During the winter months the property owner "plugs in" his trailer which we assume is to keep equipment from freezing. This action is not even allowed under the Sec. 25.04- Recreational Vehicle for a period greater than 10 days. To date the property owner refuses to supply anyone with the manufacture's data in regards to maximum load capacity. Several neighbors have spoken with various trailer manufacturers and have shown them photographs of the trailer in question. Several trailer manufactures have stated that the trailer in question can easily have a maximum load capacity of 4000 pounds (2 tons or more. The property owner has stated before the BZA that he can't currently place any more equipment in the trailer due to space restrictions. What currently is stored in the trailer has no bearing on what the trailer's currently designed maximum load capacity. The trailer as designed greatly exceeds the allowed 1500 pound (3/4 ton) maximum weight capacity. If this permit to erect the proposed carport is granted to move forward not only will this be a detriment to the Thornhurst Neighborhood, the BZA will be allowing outdoor storage for individuals using their private residence for Home Occupation and the storage of trailers exceeding the allowed three quarter ton maximum weight capacity. Also the erection of the structure for commercial purposes is a direct violation of the Thornhurst Addition Covenants. The covenants states "no structure shall be erected for commercial purposes The property owner has stated several times before the BZA that the trailer is used for his commercial business. At this time we are asking the BZA members to vote in favor of this Appeal to not allow building permit #11010015 carport structure to be erected at 37 N. Guilford Road. The structure itself is a visual detriment and does not meet the quality of architectural standards or the intent of the ordinances that have been put in place to protect the residents of the City of Carmel. Here are specific responses to the comments Mike made: Comment: I am concerned about the retaining wall and whether it will havesufficientstrength to hold the structural loads, along with the:vehicle, etc. Response:- The support structure is shown in the second drawing in the attachment., A threaded steel rod will be inserted through the middle of the 4" x6" treated landscape timbers and embedded into the concrete pier recommended by the manufacturer recommendations include per side and a size .of'8" in diameter and 18" deep). The timbers and the carport rail will then be secured with a,lock nut and washer. .In addition, after discussionwith several carpenters who have done these kinds of 'projects, the landscape tirnbersswere increased from 4`x4 ":to.4 "x6" for added stability. Although.it:is; not clearly shown on the, drawings; the north' side'of the; carport -willl have:concrete piers that match those on'the south side. The only difference in the north side .is that only one.(or possibly two at the rear) landscape timber will be necessary because of the higher groiind.surface. Comment: It is not clear that the siding details how the siding will be attached to.the frame, can you ask him for a detail of that? Response: As shown in the instruction manual included with the original permit application, the siding is attached to the frame with screws. The screws:arepaint matched to the siding. Comment: What drainage,between`the existing garage and the:proposed'structure? Response: The entire area under-the carport and between the house and thecarportwill be covered in :gravel', This'graiel will allow drainage to takeplace.in.the same fashion as,before,the carport is installed. The water wilt_ drain south under the; carport: ln heavy' downpours, there is additional drainage to the south as the -surface rs,graduallyaloped (perhaps five degrees) as well. Comment:: What; wilLthe •siding:look.like:on east side of this? how will it look where the wall and wood corne together? (or will it beopen on both ends? ;Response: The siding on:,the;east side will affix to the last support rib. This will produce a closed end with no gaps and :thecar,port roof will overhang .this.end by approximately 11 The landscape timbers will wrap around the east end of the carport:in order to maintain a consistent look and not leave unsightly gaps. At the southeast corner the side'and rear sid'rng'will meet at the last carport rib support. The seam will then be covered with a paint matched corner coverto provide a consistent look with the existing house. .I have also looked iri the neighborhood covenants for Thornhurst Addition. I know that the City of Carmel permitting .departmentris:ndt.responsible• for enforcing these covenants, but they did cause me to makean important changetin the plans that want::to. point out The property line offset for the neighborhood is 10'. Thiszre.guirres metoreduce the widthiof the carport to 10:5' and move the carport so that it touches the roof overhang!on: the house. This will still leave a 1' gap between the carport and the existing garage wall. I have 4/1-112011 also moved the carport back from the.front of the house to avoid a rain gutter on the first 3' of the house roof. The.attached.drawings indicate my final plans unless the permitting department finds,sorne things that need be changed.
