This property is currently zoned residentially (R1), which does not permit for business operations to be run from the property. The only standards that permit for a business to be run from a residential property are the Home Occupation standards of §25.18 of the Carmel Zoning Ordinance (see Enclosed). The nature of the home occupation standards is to allow a home business to operate with NO visible evidence or impact upon the property's residential character or the residential character of the surrounding neighborhood. Activities such as large commercial vehicles, gathering of employees, and storage of materials violates these regulations. There is a certain impracticality of attempting to run a construction business in a residential neighborhood in a way that would not impact the residential character, much less have no visible exterior evidence of the business when the business requires storage of machinery, vehicles, and materials, regardless of whether or not they are stored Indoors or outdoors. Inspections were performed of the property on October 24, 2007, November 1, 2007, and February 27, 2008. On each of those occasions, several large commercial grade pick up trucks, cement mixer, large commercial trailer, and storage of construction supplies inventory and trash were documented, as well as an assortment of additional miscellaneous construction materials stored outdoors. These all represent violations of the Home Occupation ordinance and it is clear that the business existing and being run from this particular residential property at 844 Bridle Court is beyond the scope of what is allowed under the Home Occupation standards of §25.18 of the Carmel Zoning Ordinance. Bring this property Into complete compliance by March 28, 2008 or additional enforcement action will commence. It should be noted that, as this is the second notice of violation, bringing the site into compliance will likely require the removal of all equipment and construction materials completely from the property. Failure to abide by the conditions of the Ordinance and to bring this site into full compliance will result in additional enforcement action including a summons to Carmel City Court and leverage of fines and court costs. Please feel free to contact me at (317) 571-2476 if you have any comments or questions. Thank you for your urgent attention to this matter.
