According to Carmel City Code §6-222 (2): Sidewalks and driveways. All sidewalks, walkways, stairs, driveways, parking spaces and similar areas on both private property and within public right-of-way across the frontage of the premises shall be kept in a proper state of repair, and maintained free from hazardous conditions. This section is not intended to create a cause of action in favor of any third party. i. The Owner or Responsible Party shall provide maintenance of existing driveways and sidewalks in the right-of-way free from conditions that cause, create or result in or represent the potential to cause, create or result in a Detriment. ii. If maintenance activity necessitates the reconstruction of existing sidewalks within the limits of the right-of-way, the sidewalk shall be permitted, bonded and reconstructed in accordance with Section §6-227 of this Code. A recent site inspection revealed that a ninety inch section of the sidewalk is missing which interferes with the connectivity for the subdivision. Unfortunately, this should have been installed by the development company prior to their exit from the subdivision and the Homeowner's Association should have required the developer to install this section as part of their punch list before assuming control of the neighborhood common areas. This section needs to be installed to be compliant with the City's Thoroughfare Plan and ordinances regarding connectivity. Please contact David Littlejohn, Carmel's Alternative Transportation Coordinator at (317) 571-2417 for the specifications for reconstruction of this sidewalk and to discuss the timeline of the work being performed. The reconstruction of the sidewalk must take place prior to July 31, 2008. If you have any questions you can reach me at 571-2476.
