IN 46032 111il COPY RE: ADLS VIOLATION — KOHL'S (CARMEL WEST) Dear Sir or Madam: This letter is being provided to inform you that it has recently been brought to the City's attention that the exterior lighting of the structure at 9895 N. Michigan Road, a property listed under your ownership, has been altered without Plan Commission approval. This property is zoned B3, a business district. As per §14.00.02.13 of the Carmel Zoning Ordinance: Architectural Design, Exterior Lighting. Landscaping and Signage. To insure the compatibility of the proposed use with adjoining areas, the Commission shall review the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) application of any proposed use of any Lot or parcel of ground within the B-3 District prior to the issuance of an Improvement Location Permit by the Department. Once approved by the Commission the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) shall not be materially or substantially changed or altered without the prior approval of the Commission. This location received ADLS approval in December 2006 (Docket #06100005 ADLS). The exterior lights recently installed in the landscaping beds that illuminate the exterior of the structure are not consistent with the approved elevations and lighting plan. Such deviations from the original plan approval require the review and approval of an ADLS Amendment. Please contact Alexia Donahue-Wold, Planning Administrator, at (317) 571-2417 for more information on the process of applying for an ADLS Amendment. Please either restore the exterior to the original design or apply for an ADLS Amendment by December 7, 2007. Failure to comply will result in further enforcement action.
