Hi Tony,
I have reviewed the file and the 32" high awning structure will be fine. The new square
footage is 23.33 and is under the allowable 60 sq. ft. I will simply update the file. No
additional approvals are required. However, this sign will need a sign permit before being
installed. Please let me know if you have any additional questions.

Hi Rachel,
Apparently this drawing was submitted wrong see (photo JPG). The actual HT needs to be 32
inches (see 540R5) and not 24 inches. Would this require a new ADLS amendment or could we get
a stamped drawing for the
32 inch HT on the face of the awning?
Please let me know as soon as you can. Thank you.

Dear Ms. Boone:
We are legal counsel to Leah and Ruben, LLC, owner of the subject property (the "Owner and
Lessor to Schuckit Associates, P.C. This letter is in response to item number 9 of your e -mail
dated Wednesday, March 25, 2011, which states "Please have the owner address the other
tenants' signage in the building. Why was their signage removed and not replaced? Why are
they not included in this new sign package? This letter also references number nine of the e -mail
received from Dan Fields dated Thursday, May 26, 2011, which states the following: "The City
of Carmel was contacted last week, by the other tenant, regarding the sign that was removed.
The City of Carmel needs a letter from the property owner explaining the situation. This letter
needs to be on letterhead and signed by the property owner. The City of Carmel is very
concerned over this. It will be brought up in the hearing, and I need to know how they would
like me to address it to the committee. Please advise." Our response is as follows:
SUMMARY: As detailed below and in the attachments:
1. The tenant "OWI chose to spend her sign allowance on other items;
2. OWI failed to obtain the required approval of Owner and the City of Carmel for the two
signs it did put up;
3. The first such sign was a torn and weathered Kinko's print tied at each corner with rope
and hung over the prior owner's dilapidated and rotting wood sign;
4. The second such sign was another Kinko's sign nailed over the previous owner's sign and
was located in front of tenant Schuckit Associates entrance, causing client confusion;

5. OWI agreed numerous times to remove the second sign but never did;
6. OWI was offered but refused to pay for space for a new sign.
7. All of the above facts were recently provided to OWI and OWI did not dispute any of
them; and
8. OWI's complaint to you immediately follows the Owner's filing of an Eviction
Complaint against OWI for failure to pay rent and refusal to cease squatting on
approximately 342 square feet of space not leased.
RESPONSE: OWI initially placed an unauthorized, unapproved, improper weathered Kinko's
print tied at each corner with rope, over the previous owner's dilapidated and rotting wood sign.
After numerous demands, OWI finally removed this sign, but put up another Kinko's sign and
nailed it over the previous owner's business sign. The sign was the grass right next to the
entrance of Schuckit Associates, P.C. It was not a professional installation AND clients were
entering Schuckit Associates' door thinking they were going to get a Foot Bath. The entrance
to OWI's business is on the other side of the building. The original wood sign underlying OWI's
sign was in disrepair and rotting. Owner informed OWI that the sign had to be taken down and
the wood sign demolished (see attached).
Knowing this was a concern for OWI, Owner's Agent, Jeri Schuckit, spent several weeks trying
to accommodate OWI by getting renderings of signage with different price points with the OWI
logo and business listed (see attached). After submitting the renderings to OWI, it said it did not
want to pay their third of the cost for the monument sign that would have both businesses listed
with directional signage as well.
OWI's Lease, Article 11(attached) provides:
OWI has been given $3,000.00 towards the cost of upgrades to the Building
Monument Sign to advertise the location of its business and the instillation of
directional signage to the Leased Premises;
OWI shall utilize the services of a licensed and bonded contractor and such plans and
specifications must be submitted to Landlord for approval. (OWI has never
submitted any proposal to Leah and Ruben, LLC since declining the signage that was
submitted to it); and
OWI is responsible for obtaining permits for its signs
Finally, please note the subject awnings extend off of the Schuckit Associates' entrances and
if OWI's name was added it would wrongly appear to be the entrance to OWI.
