conveys and warrants in fee simple and with no reversionary rights whatsoever retained, all of
Grantor's rights, title, and interest in the Property, to the City of Carmel, Indiana "Grantee
subject to all existing easements and rights -of -way of record, for the sum of One Dollar ($1.00) and
other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged.
This conveyance of real estate is not subject to Indiana gross income tax. r

ACCEPTANCE OF DEDICATION DEED OF PUBLIC RIGHTS -OF -WAY
WHEREAS, the foregoing Grantor having filed with the City of Carmel, Indiana "City its
Dedication and Deed of certain real property "Property to the City for the purpose of establishing
City rights -of -way, which Dedication and Deed is attached hereto and incorporated herein as
Exhibit "A" hereinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is desirable and
necessary and in the City's best interests;
NOW THEREFORE, the City, by and through its Board of Public Works and Safety, hereby
accepts said Dedication and Deed, and orders that the Instrument of Dedication and Deed described
herein be recorded in the Recorder's Office of the County of Hamilton, State of Indiana, and that
said described real property be, and the same hereby is, declared open and dedicated to the City.

SEPTEMBER 1, 2005
A part of the Southwest Quarter of Section 26, Township 18 North, Range 3 East,
Hamilton County, Indiana, described as follows: Commencing at the northeast corner of said
quarter section; thence South 00 degrees 10 minutes 07 seconds East 439.67 feet along the east
line of said quarter section; thence South 88 degrees 42 minutes 47 seconds West 45.39 feet,
parallel with the north line of said quarter section, to a point on the westerly right -of -way line of
Pennsylvania Street as described in Book 4, pages 697 through 701 in the Office of the Recorder
of Hamilton County, Indiana, said point being the southeastern corner of the land described in the
deed to Beverly Enterprises Indiana, Inc., recorded in Instrument number 84 -12289 in said
Recorder's office; thence South 05 degrees 43 minutes 38 seconds East along the westerly right
of -way line of said Pennsylvania Street 3.91 feet to the POINT OF BEGINNING of this
description: thence continuing along the westerly right -of -way line of said Pennsylvania Street
the following three (3) courses: (1) South 05 degrees 43 minutes 38 seconds East 64.94 feet; (2)
Southerly 76.54 feet along an arc to the right and having a radius of 788.95 feet and subtended by
a long chord having a bearing of South 02 degrees 56 minutes 53 seconds East and a length of
76.51 feet; (3) South 00 degrees 10 minutes 07 seconds East 505.21 feet; thence South 89 degrees
49 minutes 53 seconds West 10.00 feet; thence North 00 degrees 10 minutes 07 seconds West
646.27 feet to the POINT OF BEGINNING and containing 0.136 acres, more or less. The
bearings in this description are based upon the east line of the Southwest Quarter of said Section
26 having a bearing of South 00 degrees 10 minutes 07 seconds East.
