GRANT OF INGRESS AND EGRESS EASEMENT WITH REVERSIONARY CLAUSE
THIS INDENTURE WITNESSETH: That Oak View Associates, LLC, an
Indiana limited liability company (hereinafter called "Grantor
for and in consideration of the sum of One Dollar ($1.00), and
other good and valuable consideration(s), the receipt of which is
hereby acknowledged, does hereby grant to the City of Carmel,
Indiana, and its successors and assigns (hereinafter together
called "Grantee an ingress and egress easement on Grantor's
real estate hereinafter described to allow Grantee access to real
estate conveyed by Grantor to Grantee, by warranty deed, to
enable Grantee to construct and install, maintain, operate,
repair, inspect, protect, renew, remove and replace a raw water
well and water mains, together with necessary connections, valves
and other appurtenances (on land acquired by warranty deed) and
to operate by means thereof a system for the distribution and
transportation of water, and also the right of ingress to and
egress from such real estate, which is situated in Section 27,
Township 18 North, Range 4 East, County of Hamilton, State of
Indiana, and which is more particularly described as follows:

REVERSIONARY CLAUSE
ALL RIGHTS GRANTED BY THIS GRANT OF INGRESS AND EGRESS SHALL
REVERT TO GRANTOR, its successors, heirs and assigns AT SUCH TIME
AS the roads for the proposed subdivision(s) covering real estate
in the attached EXHIBIT A are dedicated to and accepted by the
City of Carmel or three (3) years from the date of this grant,
whichever occurs first. It is understood that aforesaid
dedication will convey the affected real estate in fee simple
title to the City of Carmel.
