PETITION FOR VACATION OF A PUBLIC WAY
Comes now Randall D. McNutt and Leslie McNutt (hereinafter
referred to as the "Petitioners pursuant to Indiana Code
Section 36- 7 -3 -12, and petition the Carmel City Council to vacate
a certain public way, and in support of this Petition for
Vacation of a Public Way allege and say:
1. That Petitioners are the owners of Lot 102 in the Eighth
Section of Wilson's Village, a subdivision in Clay Township,
Hamilton County, Indiana, the plat of which was recorded in the
Office of the Recorder of Hamilton County, Indiana on the 18th
day of March, 1969.
2. That the plat of the Sixth Section of Wilson's Village
was recorded in the Office of the Recorder of Hamilton County on
the 20th day of March, 1968.
3. That the plat of the Ninth Section of Wilson's Village
was recorded in the Office of the Recorder of Hamilton County on
the 28th day of July, 1970.
4. That the public way that is the subject of this petition
is described as follows:
a. The real estate shown, as "Future Street" on
the plat of Wilson's Village, Sixth Section, a
subdivision of Clay Township, Hamilton County, and also
described as 40.00 feet by parallel lines of the
Southern most portion of the Sixth Section of Wilson's
Village, as shown on the plat thereof as recorded in
the Office of the Recorder of Hamilton County on the
20th day of March, 1968, a copy of which plat is
attached hereto as Exhibit A; also,
b. The real estate shown as "Future Street" on
the plat of Wilson's Village, Eighth Section, a
subdivision in Clay Township, Hamilton County, and also
described as 40.01 feet by parallel lines of the
southern most portion of the Eighth Section of Wilson's
Village, as shown on the plat thereof as recorded in
the Office of the Recorder of Hamilton County on the
18th day of March, 1969, a copy of which is attached
hereto as Exhibit B; also,
c. The real estate shown as "Future Street" on
the plat of Wilson's Village, Ninth Section, a
subdivision in Clay Township, Hamilton County, and also
described as 40.01 feet by parallel lines of the
southern most portion of the Ninth Section of Wilson's
Village, as shown on the plat thereof as recorded in
the Office of the Recorder of Hamilton County on the
28th day of July, 1970, a copy of which plat is
attached hereto as Exhibit C.
5. That the public way marked as "Future Street" on
Exhibits A, B and C has never been constructed or utilized
as a public way or street.
6. That a list of the owners of property adjoining and
abutting the public way marked as "Future Street" on
Exhibits A, B and C is attached hereto as Exhibit D.
7. That the public way marked as "Future Street" on
Exhibits A, B and C is contiguous to Lots 60 and 62 of the
Ninth Section of Wilson's Village as shown on Exhibit C.
8. That the public way marked as "Future Street" on
Exhibits A, B and C is contiguous to Lots 99, 100, 101, 102,
and 103 of the Eighth Section of Wilson's Village as shown
on Exhibit B.
9. That the public way marked as "Future Street" on
Exhibits A, B and C is contiguous to Lots 104 and 105 of the
Sixth Section of Wilson's Village as shown on Exhibit A.
10. That all Lots contiguous to and abutting on the
public way, marked as "Future Street" on Exhibits A, B and C
are located within the corporate limits of the City of
Carmel, Indiana.
NOW, THEREFORE, Petitioners request the Carmel City
Council vacate said Public Way "and terminate the public
right -of -way in all respects except for the use and
maintenance of any utility that is currently existing and in
use on said right -of -way.

CITY COUNCIL MEETING
DECEMBER 6, 1982
The meeting of the City Council was called to order by Mayor Reiman at 7:30 P.M. on
7 -,.December 6, 1982. Council members Fleming, Johnson, Garretson, Kerr, McMullen,
''Balker and Shepherd were present. Also present was City Attorney, Dave Coots and
'Clerk- Treasurer Dottie Hancock.
Johnson gave the invocation which was followed by the Pledge of Allegiance.
Police Chief, Jerry Lowe presented letters of commendation to Lt. Bob Smith and
r: ;,Sgt. Greg Meeks for their work in breaking a burlary ring.

,Mrs. McMullen stated that the minutes should reflect that it is a requirement of
'4` the M -3 zoning that a road be completed before any building is done not just a
criteria of the Plan Commission. Mr. Fleming stated that in the portion of the
relating to Ordinance D -358 the record should be corrected to show that
Mr Lambert is a resident of Westfield and the heliport is at Westfield. Mrs.
Kerr asked Mr. Garretson if his suggestion on Ordinance D -357 was a part of this
rotion to table. Mr. Garretson stated the motion was only to table, the suggestion
t outside the motion voted upon. Mrs. Kerr made a motion to approve the minutes
with the above corrections and that the memorandum of November 22 be approved.
Motion seconded by Mr. Fleming and passed unanimously.
Business
4Ordinance -Z189 Rezone for Manufacturing Zone The Council was in receipt of
a finding of fact from the Plan Commission. Mrs. Kerr questioned the validity
of the finding of fact from the Plan Commission in that it was signed by Mr. Merrill
and had not been voted upon by the Commission. Mr. Merrill, Plan Commission President,
stated he had prepared the finding of fact based upon a review of the record. Mr.

"the agenda and felt it would be unwise to pass the rezone before the comprehensive
,plan update was completed. Mrs. Kerr stated she agreed with Mr. Fleming. Mrs.
McMullen pointed out that the Petitioner had come to the Council a year ago and
that the comprehensive plan update was at least another year away. Following further
ZC discussion, vote was taken on Ordinance Z -189 which passed 4 -3, Kerr, Walker and

of fact from the Plan Commission a part of the record. Motion seconded by Mrs.
F; McMullen and passed 5 -2, Fleming and Kerr voting nay. Mrs. Kerr stated her nay
vote was because she did not feel the finding of fact was a reflection of the whole

Ordinance D -358 Taxi Ordinance Mr. William Lambert appeared before the Council
to address his request for passage of a new taxi ordinance. Mr. Coots suggested
14;1 that if the Council felt it wanted to adopt a new ordinance, D -358 should be amended

in places. Following discussion, Mrs. Kerr made a motion to have Mr. Coots, Mr.
Lambert and Mr. Lanibert's attorney, Mr. Faust work to revise the proposed ordinance.

to Mr. Coots that the designees for review address a time limit for the franchise,
i'setting out a consumer complaint procedure, provide for a review of reissue at
expiration of the franchise and a provision to separately address limosine service.

lotion to allow Mr. Lambert permission to operate a taxi service under the existing
ordinance. Motion seconded by Mr. Fleming and passed unanimously.

CARMEL PLAN COMMISSION MINUTES OCTOBER 19, 1982 jt
She regular meeting of the Carmel Plan Commission was called to order by
the president, Bill Merrill, at 7 :30 P.M. October 19, 1982 at the City Meet-
ing Hall. The meeting opened with the pledge of allegiance.
Roll was called and members present were: Ila Badger, Jeff Davis, Vaughn
Story, Hans Gundersen, Steve Terry, Sue McMullen, Bill Merrill, Clyde Riley,
Terry Litvan, Fred Ellis, Sandra Long, Richard Albright and Bob Boone.
John Hensel, Clay Township Trustee, was present to swear in new Commiss-
ion member, Bob Boone. Mr. Boone is replacing Phil Conklin who resigned
October 1, 1982.
Mrs. Badger moved that the minutes of the September 21, 1982 meeting be
approved as submitted.
Seconded by Dr. Long.
Mr. Gundersen called attention to page 5 of the September 21 minutes,
item 6h, and asked that the vote be corrected to read 6 For, 1 Against and
1 Abstaining. (Mr. Gundersen Against and Mrs. Litvan Abstaining)
The motion was amended to approve that change and the minutes stand
approved as corrected.
Mrs. Litvan suggested that Mrs. McCart send a letter to Public Service
on 116th St. thanking them for redoing their landscaping.
Mr. Merrill said that he will get together with Mrs. McCart and take
care of this matter.
H. Old Business

Carmel /Guilford Associates, for 267.1 acres located on either side
of Guilford Rd. south of approximately 126th St. from R -1 and R -2

There was a 5 minute recess for members to review all the materials
from the Land Use Committee.
Following recess, Mrs. McMullen read the Land Use Committee report (which
is a pert of the official minutes and attached to the master copy). The
committee meeting was continued until 6 :45 P.M. this evening and a motion
from the Land Use Committee was read by Mrs. McMullen and is a part of the
official minutes and attached to the master copy. The committee recommend-
ed approval based upon the understanding and commitment by the applicants
as stated in the committee motion.
Mrs. McMullen moved that this motion be placed into the record with the
amendment that in item 4, "right of way" replace "easements
Seconded by Mrs. Badger.
Members questioned items in the motion.
Mrs. Badger made comments regarding the rezone.
Ballots were cast for item lh, Docket No. 14 -82 Z.
The motion for the rezone carried 11 For, 1 Against, Mr. Gundersen

Carmel Research Development Park
"Motion duly made and seconded that:
The Land Use Conmittee recommends granting the application for rezone of 267.1
acres from R -1 /R -2 zoning classification to M -3 zoning classification for Research
and Development Park in accordance with Preliminary Development Plan and documents
on file in support thereof, based upon the following understanding and commitment
by the applicants:
1. The Declarations of Development Standards and Restrictions, as amended, and
attached herein shall be made a part of the formal Development Plan.
2. That immediately following rezone of the acreage by enactment of ordinance by
the Carmel City Council, application will be made in a coordinated effort by
the Carmel City Engineer, Carmel Board of Works, Department of Community Develop-
ment, Carmel Plan Commission and the applicants for this rezone to deter the
best direct access to U.S. Highway 31.
3. That development of the Park will be in a simultaneous sequence in that as multi-
family building is commenced in one segment of the -Park, other land uses else
where in the Park, such as warehouse, commercial or office warehouse units will
also be constructed in a manner that when one 10 -acre land use is under con-
struction, another land use, elsewhere, of comparable size will also be under
construction.
4. That the Plan Commission recommend to the City of Carmel that there be no
street connections between 126th Street and Wilson Village, including Wilson Drive
East, which does not adjoin the Park and further recommend that existing easements
for 126th SL. along the south line of Wilson Village be vacated. 2` eva7
5. That as the area of the Park is developed along the east line of Guilford Road,
appropriate space will be dedicated for pedestrian use and sidewalks will be in-
stalled as the particular area develops, primarily as a safety route for children
moving north south along Guilford Rod.

6. That prior to Plan Commission approval of Final Development Plans in any quad-
rant (NE, NW, SE, SW, refer to attached map) that primary roads including 126th
Carmel Dr. and College Ave. (as extended in the M -3 District) shall be completed
per Carmel Subdivision Regulations with direct access to U.S. 31 and /or Range
Line Rd. within and adjacent to the respective quadrant.
