Rain checks will be honored on postponed date. Retain the rain check affixed to the tickets as no money will be refunded in case of postponement. All persons, regardless of age, must have a reserved seat ticket for admittance to seating areas. Acceptance of ticket orders for IMS events does not occur until the tickets are mailed by IMS or otherwise delivered to the customer. Renewal of specific seats and allocation of tickets are at the discretion of IMS. As such, large orders for specific seating and /or parking areas may require partial reallocation (reassignment) and /or substitution in alternate areas and IMS reserves the right to deny renewal requests as to tickets that are subsequently re -sold at inflated prices even if the original purchaser did not profit from the re -sale. PARTICIPATION IN THIS RACING EVENT AS A SPECTATOR IS AT YOUR OWN RISK. ("NASCAR") and all directors, officers, members, shareholders, owners, affiliates, employees and agents of each of the foregoing from any and all claims arising from the event, including claims of negligence of releasees. Tickets may not be used for advertising, promotion (including contests and sweepstakes) or other trade purposes without the express written consent of IMS. A ticket is a revocable license. IMS reserves the right to revoke any ticket either before, during, or after the event, for such reasons as IMS deems appropriate in its sole and absolute discretion. A ticket only entitles the holder to admission to the grounds of the Indianapolis Motor Speedway on a specified date and for a specified seat, and subject to the holder's compliance with the rules, regulations and policies of IMS. No other rights of any kind are conveyed to the holder of any ticket. The ticket holder grants IMS and its designees the right to use the ticket holder's image and/or likeness in any live or recorded video display or other transmission or reproduction of the event, including without limitation his /her rights of publicity. The bearer of any tickets purchased via this document agrees not to take any action, or cause others to take any action, which would infringe on the rights of IMS or its designees. As to the Red Bull Indianapolis GP, all rights to broadcast, record, photograph, repeat, reproduce or recreate the events (including the competitors, motorcycles and /or riders), directly or indirectly, are reserved to Dorna and /or IMS. The foregoing does not prevent any person attending the events from originating amateur video recordings solely for his/her private enjoyment at the areas specifically designated for that purpose. The ticket holder grants Dorna and IMS and their designees the right to use the ticket holder's image and /or likeness in any live or recorded video display or other transmission or reproduction of the event, including without limitation his /her rights of publicity. As to the Allstate 400 at the Brickyard, NASCAR owns all rights to broadcast, transmit, film, tape, capture, overhear, photograph, collect or record by' any means (including but not limited to television, cable television, radio, pay per -view, closed circuit television, satellite signal, digital signal, and the Internet) all images, sounds and data arising from or during any NASCAR event and NASCAR shall be the sole owner of any and all copyrights, intellectual property rights, and proprietary rights worldwide in and to these works and in and to any other works, copyrightable or otherwise, created from the images, sounds and data arising from or during any NASCAR event.
