landscaping and a fence that surrounds the
corner where this sign is located. The LED pricing sign has been removed and will have manually changed prices now.
The price sign size has been increased to 18" from 12" and is now more visible on the sign.
The Department is in support of the variance for 100% logo for the Circle K sign above the entrance to the convenience
store and on the east elevation of the store. The size of each sign has been reduced from 25 sq. ft. each to 14.7 sq. ft. each.
The Petitioner is now requesting to split the allowable 30 sq. ft. for one wall sign into two 14.7 sq. ft. wall signs. The
Department believes this is a good compromise and can support the request.
With the reduction of wall signs and the elimination of the canopy signs, the overall requested square footage is now
within what the sign ordinance allows and that variance is no longer needed. The square footage allowed is 75. The
Petitioner is requesting 65.4 sq. ft. Please see the petitioner's informational packet for more detail.
Findings of Fact:
1. The approval of these variances will not be injurious to the public health, safety, morals, and general welfare
of the community because: the proposed signage exceeds what the Sign Ordinance allows by a small amount.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the current signage will basically be replaced on a one for one rate. It will
not take away from other businesses in the area or put them at a competitive disadvantage.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties
in the use of the property because: the two "tenants Circle K and Shell will be at a competitive disadvantage from
other businesses in the area.
Recommendation: After all concerns have been addressed, the Dept. of Community Services recommends POSITIVE
consideration of Docket Nos. 11040020 11040021, 11040023, 11040026 V. (Docket Nos. 11040022, 11040024
