Petitioner, please note the following:
1. This Item will not be on an agenda of the Technical Advisory Committee.
2. Mailed and Published Public Notice needs to occur no later than Friday, August 12. Published notice is
required within the Indianapolis Star. Note: the placement of a public hearing sign on the property is also
required by the BZA Rules of Procedure, Article VI, Section 6 (see attached PDF).
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, August 19. Failure
to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley no later
than NOON, Friday, August 12. Failure to submit Informational Packets by this time will result in the automatic
tabling of the petition to the September 26, 2011 agenda of the BZA.
5. This Item will appear on the August 22, 2011 agenda of the Board of Zoning Appeals Hearing Officer under
Public Hearings.
6. The petitioner will need to provide a fully filled -out Findings -of -Fact sheet for each petition the night of the
meeting for the Board's use (Sheet 8). On Ballot sheets, only fill out docket number, petitioner, and date (Sheet
7). Ballot sheets must be collated.
7. Either the Petitioner or someone representing the Petitioner must be present at the meeting for the item to be

Variance of Development Standards
for an
Additional Identification Wall Sign
Applicant, ISG Real Estate Investments, LLC, by James Browning, requests a Variance of Development
Standards of the Sign Ordinance of the Carmel Zoning Ordinance for the establishment of aradditional
wall sigrfto be located on the southwest facade of the Indiana Spine Group Building (currently under
construction) located at 13225 North Meridian Street, Carmel, Indiana, in accordance with the drawings
filed with this Application.
Details of Variance:
Permitted:
Section 25.07.02 -08(b) NUMBER TYPE: The maximum number of Identification Signs
permitted shall be one (1) sign for each Frontage on a public street (not alleys) with a maximum of
three (3) signs for lots with three (3) or more Frontages. A building owner with two (2) or more
Frontages may elect to transfer a permitted sign from one Frontage to another to permit no more
than two (2) signs to be oriented to one (1) Frontage as follows: one (1) Wall or Roof Identification
Sign and one (1) Ground Identification Sign.
Request:
Permit one (1) additional Wall identification Sign to be located on the southwestern facing facade
which has no Frontage on a public street, but is visible from U.S. 31.
History and Details:
The Indiana Spine Group is developing a new medical office building at 13225 N. Meridian Street in the
Meridian and Main Office Park which is accessed via Main Street immediately east of U.S. 31. The
property is zoned B -6 and is within the U.S. 31 Overlay District. The new medical office building has
frontage on U.S. 31 and on Grand Avenue. Grand Avenue intersects with Main Street and is the primary
thoroughfare serving the Meridian and Main Office Park. Grand Avenue will ultimately be dedicated to
the City of Carmel as a public right -of -way. It is anticipated that the construction and dedication of Grand
Avenue will be completed in the fourth quarter of 2011. Prior to the dedication of Grand Avenue as a
public right -of -way, the building was entitled to a single wall sign on the U.S. 31 facade (northwestern
facade) per the Sign Ordinance. A Variance of Development Standards was granted at the September 28,
2009 BZA Hearing to permit a second wall sign facing Grand Avenue (southeastern facade) (Docket Nos.
09080006 V through 09080008V). The Variance of Development Standards for the second wall sign will
no longer be required after Grand Avenue is dedicated as a public right -of -way.
Due to the location of the building being on the interior curve of U.S. 31, the permitted wall sign facing
U.S. 31 is not visible to northbound traffic until a vehicle has passed the U.S. 31 interchange with Main
Street. The Applicant's request is for a Variance of Development Standards to place e k Identification
SigAn the southwestern facade of the Building, which will be visible to northbound traffic prior to
passing the U.S. 31 interchange with Main Street.

FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE

1. The approval of this variance will not be injurious to the public health, safety, morals and
general welfare of the community because: The building is located adiacent to U.S. 31
and within the Meridian and Main Office Park. The additional signaqe will not be visible
to adiacent developments and is compatible and consistent with other signaqe in this
high traffic corridor. The Office Park and building may only be accessed via West Main
Street. Without the additional wall sign, the building's identification will not be visible to
northbound traffic until after passing through the interchange providing access to the
Office Park. The additional wall sign will provide a safer route for accessing the building
and avoid associated public safety concerns resulting by visitors trying to turn around on
U.S. 31 after passing the appropriate interchange.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: The signaqe has been designed to
be architecturally compatible with the size and architectural elements of the building and
will enhance the appearance of the building, contributing to the value of the building and
thus having a positive impact on the value of surrounding properties.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: The primary access to the
building is from the intersection of U.S. 31 and Main Street. To not have signaqe visible
to northbound traffic would (a) create a hardship in the ability to lease the property and in
the ability of customers or user of the services within the building locate the appropriate
building, and (b) create an unnecessary risk to public safety.
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development
Standards Variance Docket No. is granted, subject to any
conditions stated in the minutes of this Board, which are incorporated herein by reference and
made a part hereof.
