Comments on the revised landscape plan received January 12, 2001 are as follows:
1. There are five Acer rubrem (Red Maple) listed on the plan. This species should not be used at
this site, besides being overused in this area; they are an invasive species that could colonize
the wetlands and banks of the Cool Creek waterway. A northern species of Quercus rubrem
(Red Oak) would be a suitable alternative.
2. The note on the shrub planting detail which states "SHRUB PLANTED AT SAME RELATION
TO FINISHED GRADE AS IT BORE TO PREVIOUS EXISTING GRADE" should be struck
and replaced with ALL PLANT MATERIAL TO BE PLANTED WITH ROOT CROWN AT
GRADE.
3. The written portion of the TREE PRESERVATION PLAN is acceptable, but it should be
accompanied by a site plan with construction details, including but not limited to; line of
construction limits, areas of trees to be preserved, fencing details, material storage and parking
areas.

Please find attached a copy of the inspection results from the Ritters
Frozen Custard to date, and a copy of a complaint on the property.
I have attached project-notes on the inspection results page concerning
the site. In a normal situation, once a commercial new structure needing
a site inspection has a final inspection by the building inspectors which
passes, I send a sheet up to Scott letting him know it should have a site
inspection. HOWEVER, there is something quite different going on
here. Scott, I don't know if this (what is detailed in myproject notes) is
what was agreed on concerning the site inspection, but it seems a bit
strange to me. Also Scott, you need to be aware that we have an active
complaint and issue regarding signage on this project.

This office has reviewed the revised plans submitted to this office on March 19. 2001. We offer the,
following comments:
SHEET C3
Show parking lot drainage direction by arrows. Include high point at drive -lo cause minimal runoff to
go out drive into Rangclinc Road.
Show spot elevations for roadside swale to be established (Only showing curb Turnout. and proposed
1.00% grass wale. Nccd a little more detail).
Could not find rip rap sirs indicated. Needs to be 8' minimum. cut 16 into ground.
GENERAL
We request the comniitincnt letter regarding future sidewalk /asphalt path installation be recorded in the
Hamilton County Recorder's Office. I apologize for not relaying this requirement to you sooner.
There is a "repair of cuts within pavement limits" ou Sheet C6. We are assuming this has no
application on this development. at least as far as Rangcline Road is concerned. Pavement cuts on
Rangclinc Road are not allowed without Board of Public Works and Safety approval.

I have had an opportunity to review your opinion regarding the applicability of the
Horizontal Property Law to the US 31 Overlay Zone, and I am left with one or two questions:
First, nowhere in your memo do you discuss how an HPR gets the petitioner past the
requirement of Section 23B. 7(B), which states, "If a Parent Tract (Tract) is located both inside and
outside of the U.S. Highway 31 Overlay Zone, a DP shall be submitted to the Commission for the
entire tract."
PARENT TRACT is defined (per Z -340) as, "A tract of land described by metes and
bounds, the description of which has been recorded in the office of the Hamilton County Recorder
of Deeds and which existed prior to the date of the adoption of this ordinance."
The parent tract on which the Ritter's Frozen Custard will be developed clearly falls into
this category.
Second, while I recognize that HPRs are excused from the procedures of the Subdivision
Control Ordinance as cited in I.C. 36- 7- 4- 702(e), nowhere in either I.C. 36 -7 or I.C. 32 -1 -6 do I find
exemption from the Zoning Ordinance. That being the case, the entire parent tract must still go
through the Development Plan process with the Plan Commission unless the Overlay requirements
are lifted from the parent tract itself. Dividing the tract, be it through Subdivision or HPR, does not
release the remainder of the parent tract as it existed prior to May 1, 2000, from those requirements.

Gentlemen:
This letter will confirm, based upon our discussion and your opinion that
the applicant under Docket No. 205-000Z with the use of the horizontal property
regime can proceed to obtain an Improvement location permit for its frozen
custard business In the B -2 zone.
The opinion is premised upon Ritter's creating a legal description by use
of the horizontal property regime, which Iles completely outside of the US 31
overlay zone and submitting the legal description in its application for
improvement location permit.
Therefore, based upon the above facts and the representation that the
applicant can obtain an improvement location permit, we are withdrawing our
application for rezone set for public hearing on February 20,2001.

Proposed Use of Horizontal Property Law
Petitioner here has sought a favorable recommendation to rezone a parcel that is zoned B -2 and
is located northwest of 8th Street N.W. and North Range Line Road. A small sliver of the
northwest corner of the parcel lies within the U.S. 31 Overlay Zone, which ordinarily would
subject the entire parcel to the DP /ADLS process prescribed by the Overlay Zone Ordinance.
The pending rezone petition would leave the parcel zoned B -2 but remove it entirely from the
Overlay Zone, predicated on: (1) Petitioner's representations that he does not intend to make any
improvements to the sliver that lies within the Overlay Zone, and (2) Petitioner's commitment
that if in the future that sliver is developed, he will follow the DP -ADLS process.
Petitioner's attorney, Gordon Byers, has now informed me that Petitioner intends to drop his
rezone request and instead employ the Indiana Horizontal Property Law, IC §32 -1 -6 -1 et seq., in
this development. His primary purpose is to save time so that the frozen custard store can be
constructed before the summer season begins. This approach will allow Petitioner to sever the
sliver from the parcel without going through.the typical platting process called for by our
Subdivision Control Ordinance; this is because of the state law that provides: "The subdivision
control ordinance may not regulate condominiums regulated by IC 32 -1 -6." IC §36- 7- 4- 702(e).
In summary, as I understand it, the owner of the parcel will create a "contractable condominium"
(as defined in•IC §32- 1- 6 -2(d)) with "withdrawable land" consisting of the part of the parcel that
lies within the Overlay Zone. Then; after the condominium has been duly created and recorded,
he will "withdraw" the withdrawable land —the sliver —from the condominium pursuant to IC
§32 -1 -6 -15.3. Finally, he will submit his application for a building permit to build his custard
store on a "contracted condominium" that is situated entirely outside of the Overlay Zone. In my
opinion, this will be a lawful use of the state's Horizontal Property Law, and it will not violate
either the letter or spirit of our Overlay Zone Ordinance.
