A northern species of Quercus rubrem (Red Oak) would be a suitable alternative. 2. I have attached project-notes on the inspection results page concerning the site. In a normal situation, once a commercial new structure needing a site inspection has a final inspection by the building inspectors which passes, I send a sheet up to Scott letting him know it should have a site inspection. HOWEVER, there is something quite different going on here. Scott, I don't know if this (what is detailed in myproject notes) is what was agreed on concerning the site inspection, but it seems a bit strange to me. Also Scott, you need to be aware that we have an active complaint and issue regarding signage on this project. PARENT TRACT is defined (per Z -340) as, "A tract of land described by metes and bounds, the description of which has been recorded in the office of the Hamilton County Recorder of Deeds and which existed prior to the date of the adoption of this ordinance." The parent tract on which the Ritter's Frozen Custard will be developed clearly falls into this category. Second, while I recognize that HPRs are excused from the procedures of the Subdivision Control Ordinance as cited in I.C. 36- 7- 4- 702(e), nowhere in either I.C. 36 -7 or I.C. 32 -1 -6 do I find exemption from the Zoning Ordinance. That being the case, the entire parent tract must still go through the Development Plan process with the Plan Commission unless the Overlay requirements are lifted from the parent tract itself. Dividing the tract, be it through Subdivision or HPR, does not release the remainder of the parent tract as it existed prior to May 1, 2000, from those requirements. Molitor DATE: February 16, 2001 RE: Docket No. 205 -00 Z; Ritter's Frozen Custard Proposed Use of Horizontal Property Law Petitioner here has sought a favorable recommendation to rezone a parcel that is zoned B -2 and is located northwest of 8th Street N.W. and North Range Line Road. A small sliver of the northwest corner of the parcel lies within the U.S. 31 Overlay Zone, which ordinarily would subject the entire parcel to the DP /ADLS process prescribed by the Overlay Zone Ordinance. The pending rezone petition would leave the parcel zoned B -2 but remove it entirely from the Overlay Zone, predicated on: (1) Petitioner's representations that he does not intend to make any improvements to the sliver that lies within the Overlay Zone, and (2) Petitioner's commitment that if in the future that sliver is developed, he will follow the DP -ADLS process. Petitioner's attorney, Gordon Byers, has now informed me that Petitioner intends to drop his rezone request and instead employ the Indiana Horizontal Property Law, IC §32 -1 -6 -1 et seq., in this development. His primary purpose is to save time so that the frozen custard store can be constructed before the summer season begins. This approach will allow Petitioner to sever the sliver from the parcel without going through.the typical platting process called for by our Subdivision Control Ordinance; this is because of the state law that provides: "The subdivision control ordinance may not regulate condominiums regulated by IC 32 -1 -6." IC §36- 7- 4- 702(e). In summary, as I understand it, the owner of the parcel will create a "contractable condominium" (as defined in•IC §32- 1- 6 -2(d)) with "withdrawable land" consisting of the part of the parcel that lies within the Overlay Zone. Then; after the condominium has been duly created and recorded, he will "withdraw" the withdrawable land —the sliver —from the condominium pursuant to IC §32 -1 -6 -15.3. Finally, he will submit his application for a building permit to build his custard store on a "contracted condominium" that is situated entirely outside of the Overlay Zone.
