Docket No. 07070040 PP: Chesterton Woods Subdivision The applicant seeks primary plat approval for 14 lots on 9 acres and also seeks the following subdivision waiver approvals: Docket No. 07070042 SW. SCO Chapter 6.03.15 street curvature radius Docket No. 07070043 SW SCO Chapter 7.05.07 percent of woodland clearing The site is located at 2405 E 99 Street, near Haverstick Rd. and is zoned S- 2/Residence- ROSO. Filed by Matt Skelton of Baker Daniels LLP for 56 Development, LLC. The petitioner seeks primary plat and subdivision waiver approvals for 14 residential lots on 9 acres. This is a density of 1.55 units per acre, and so, the development is subject to the requirements of the Open Space Ordinance. The minimum open space requirement is 20 and the petitioner proposes 22.5 This parcel is heavily wooded, and tree preservation is key. The proposed `pond' is a dry retention collection basin to remain dry most of the time. The Department does have concern with the subdivision waiver request for the percent of woodland clearing; the percent of woodland clearing allowed, about 30 is based on the maturity of the trees. The petitioner is proposing to remove approximately 72% of the trees in the existing wooded area. The City Forester relayed a concern about tree preservation on these wooded lots, and that there may be a conflict with tree preservation and citing these large homes driveways on the proposed lots. Construction equipment will probably damage additional trees within the tree preservation areas. At the Oct. 2 committee meeting, -the committee voted 3 -2 to move the related primary plat item and street curvature radius waiver to the full plan commission with a favorable recommendation with the following conditions: 1) agrees to work with a registered consulting arborist, 2) driveways will be 16-ft wide or less and any additional driveway with will be composed of pervious pavers, and 3) the pedestrian path will be comprised of crushed stone. At the Oct. 2 committee meeting the vote was 3 -2 to keep the subdivision waiver item in committee and to have a tree inventory of trees 16 inches or greater in the non- hatched areas of the tree preservation plan, excluding ponds. This tree inventory has been submitted. At the Nov. 29 committee meeting, the vote on the waiver for the percent of tree clearing was a 5 -0 favorable recommendation.to the pull plan commission with the condition that the petitioner commit to hiring a Registered Consulting Arborist. DOCS comments /concerns: 1) The City Forester received a copy of the tree inventory. While the inventory seems accurate, he has some concern about there possibly being too much use on the site. The petitioner and Scott are working out some final tree preservation plan issues. 2) The Engineering Department is comfortable with the Plan Commission approving the plat with the following condition: that no construction or secondary plat approval will occur without a drainage outlet. The Department of Community Services recommends the Plan Commission vote on these items this evening. If the final vote approves these items, DOCS recommends attaching a condition that no construction or secondary plat approval will occur without a drainage outlet.
