If you do not intend to construct a sidewalk along 2 St NW you can contribute to the City's Non Reverting Thoroughfare Fund or you can request a variance. The contribution to the City would be for an amount equal to the cost of constructing the sidewalk and would relieve you of your responsibility of including it with this project. To determine the contribution amount you would work with Gary Duncan in our Engineering Department: Typically you would submit an estimated cost for constructing the sidewalk and Gary would review it. If you rather pursue a variance you would have to submit a development standards variance application for review by the BZA. Typically our department does not support these types of requests. What if the 3 homeowners maintained and owned a shared access /ingress /egress easement to access their 3 garages, and there was not a platted alley at this location? That way, the City does not have more pavement to maintain, and the homeowners can use this as a private driveway. (Also, I did not see a platted alley on the Henry Roberts Heirs Addition plat at this location, it just looks like there might be a gap between your parcel and the plat to the east, so this might be a good solution.) The Follett Morrow drain overlaps our property at 130 2nd Street NW in Carmel on each side. On both the east and west side of the property the center line of the drain is significantly off the actual property, either across a street or an alley. I assume you would grant us a variance from the 75' easement. Last time we sought and were granted a 15' non enforcement. In this case a 25' or 30' would be more than sufficient. Do you see any problem with us going ahead and filing the request?
