'Ward, C[F.31 Surveyor of i (amilton County ("Phone (317) 77 `Fax (3 776 -9628 RE: Use Variance 3610 West 96 Street Suite 188 One .7 (amilton County Square Noblesville, Indiana 46060 -2230 We have reviewed the use variance submitted to the Hamilton County Surveyor's Office on June 10, 2011, for this project and have the following comments: 1. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of Carmel. 2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone. 3. The proposed project falls in the Crooked Creek Regulated Drain Watershed. 4. The open ditch across the front of this parcel is part of the Crooked Creek Regulated Drain. 5. While the Surveyor Location Report is correct in the fact that the subject property does not lie within a Special Flood Hazard Zone per Community Panel Number 18057CO215F, there IS still unstudied floodplain on this parcel. Based on the regulated drain watershed mapping, approximately 710 acres drain through this open regulated drain across this parcel. That does indicate that more the 1 square mile of upstream drainage area is present and Indiana Department of Natural Resources Division of Water could have Floodway jurisdiction over this stream at this location. 6. Per Indiana Code 36- 9- 27 -33, no new landscaping (trees) are allowed in the Crooked Creek Regulated Drain Easement without prior written approval of the Hamilton County Drainage Board. 7. The existing driveway crossing for this parcel is extremely undersized for the upstream drainage area and does overtop on a regular basis. The attached photos show the overtopping during a moderate storm event on June 4, 2008. Since this is the only access to this parcel, it would be highly recommend that the pipe under the driveway be increased in size to limit the frequency of the driveway overtopping events. 8. All improvements to the regulated drain and within the easement need to be approved by Hamilton County Surveyor's Office prior to construction.
