1. This item will be on the Wednesday, March 16 meeting agenda of the Technical Advisory Committee (TAC),
which begins at gam. If not done already, the petitioner must submit plans and review materials to all TAC
members ASAP via email and /or mail. The updated TAC members list is online at:

2. Mailed and Published Public Notice needs to occur no later than Friday, March 25. Published notice is required
within the Indianapolis Star. Try to get the public notice ad to the IndyStar by Noon, two days prior to the public
notice deadline, in order for them to publish it on time. Also, the placement of a public hearing sign on the
property is required; see application.
3. The Filing Fee and Fifteen (15) Informational Packets must be delivered to Plan Commission Secretary
Ramona Hancock no later than Noon, Friday, April 8.
4. Proof of Notice will need to be received by this Department no later than Noon, Friday, April 15. Failure to
submit Proof of Notice by this time will result in the tabling of the petition.

Section 23B.08.01.D of the US Highway 31 Corridor Overlay Zone district of the Zoning
Ordinance; Buildings shall be sited consistent with the Building Setback Line of the
underlying zoning.
State explanation of why waiver is being requested:
The waiver is being requested to allow the building to be located with a minimum building
setback of 40' from the Smokey Row right -of -way. The current standard is 60'.
State reasons supporting waiver request:
The placement of the building meets the intent of the US 31 Overlay by providing a setback that
allows buildings to be sited closer to the US 31 and other adjacent rights -of -way.
