Docket No. 04010001 Z; Dunkerly Property - Rezone The applicant seeks to rezone approximately 2.4 acres from R-l/Residence to B- 2/Business (with res~cted nscs). The site is located at the northwest comer of Guilford Rd and 116th St. Filed by Joseph Calderon of Ice Miller on behalf Mr.& Mrs. Dunkerly. The applicant is requesting a favorable recommendation from the Plan Commission to rezone the subject property from the existing R-1 / P, esidential classification to B-2 / Business. Please see the information packet for an overview of the proposal. While the applicant has provided a proposed site layout and building elevations there is no commitment to construct the site in the illustrated manner. However, the Department is aware that it is there intent to develop the site consistent with the information contained in the informational packet. To that end that applicant has not been responsive to requests made to lay out the site with the buildings pulled up to the street with parldng to the rear and side of the buildings. They have also been strongly encouraged to provide two story structures as opposed to the single story structures illustrated in the information packet. Thc Plan Commission and City Council have an opportunity at this location to establish the future character and identity for this parcel and the other underdeveloped real estate along Guilford and 116th Street adjacent to this site. Tab 5 of the information packet shows the adjacent underdeveloped areas. The City has been consistent in its message to prospective owners and developers of the area in our desire to see tho above mentioned site characteristics and multi-story buildings with a mix of uses. The area north of 116~h Street and west of Guilford Road is planned for future commercial uses under the Comprehensive Plan. We look forward to working with a developer that is responsive to the vision the city has for the development of real estate in this area. There is no need to take up committee time with the current proposal. If the applicant contem, pl.ates changes to the .~ropos .al they. should be pr. esen,t, ed to .the public and entire Comm~sston at the March I6 meeting prior to advancing dtscusslon to committee. However, ff changes are not contemplated the Department recommends that this item be forwarded to the City Council with an unfavorable recommendation. pCR-2004-0217
