Mayor Brainard called the meeting to order at 6:00 p.m. Reverend Anastasios Gounaris, Holy Trinity Greek Orthodox Church of Indianapolis, pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Griffiths made a motion to approve minutes from the September 6, 2011 Special Meeting. Councilor Snyder seconded. Councilor Carter addressed the Council regarding the noise at the Detour restaurant on Main Street and thanked the Carmel United Methodist Church and Northview Christian Church for their recent 911 Memorial Service. Councilor Accetturo addressed the Council regarding the 911 Communications Center. Councilor Sharp addressed the Council regarding the 911 Communications Center and also addressed Health Insurance for the Council. Councilor Seidensticker addressed the Council regarding the recent Public Safety Day and also discussed a recent fundraiser at the Mansion for the Safe Families for Children. This organization provides a network for families. Mayor Brainard addressed the Council regarding the 911 Communications Center. ACTION ON MAYORAL VETOES: There were none. CLAIMS: Councilor Griffiths made a motion to approve claims in the amount of $1.,420,648.89. Councilor Snyder seconded. There was no Council discussion. Council President Seidensticker called for the vote. Claims were approved 7 -0. COMMITTEE REPORTS: Councilor Snyder reported that the Finance, Administration and Rules Committee had met on September 13, 2011 and discussed Ordinance D- 2040 -11, Ordinance D- 2045 -11 and Ordinance D- 2046 -11 which were forwarded to the Council with a favorable recommendation. The committee report will be given when the item appears on the agenda. The committee also met on September 15, 2011 and discussed Ordinance D- 2051 -11 which remains in committee. The committee also discussed Ordinance D- 2052 -11 and Ordinance D- 2043 -11 which were forwarded to the Council with a favorable recommendation. Ordinance D- 2050 -11 was forwarded back to the Council for further discussion. The committee report will be given when the item appears on the agenda. The next meeting will be held on Thursday, October 20, 2011 at 5 :30 p.m. 2 Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee had not met. The next meeting will be held on Tuesday, September 27, 2011 at 5:30 p.m. Councilor Carter reported that the Parks, Recreation and Arts Committee had not met. Councilor Griffiths reported that the Utilities, Transportation and Public Safety Committee had met on September 12, 2011 and discussed Ordinance D- 2047 -11 which was forwarded to the Council with proposed amendments. The committee also discussed Ordinance D- 2049 -11 which was forwarded to the Council with a favorable recommendation. Brad Meyer, Council representative on the Carmel Redevelopment Commission, was available for questions regarding the financial activities of the Carmel Redevelopment Commission. There was brief Council discussion. Mayor Brainard addressed the Council. OLD BUSINESS Council President Seidensticker announced the Third Reading of Ordinance D- 2040 -11; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the Carmel City Court for the Year 2012. Thank the Council 1. This city has taken much pride in its growth, from 1500 in mid -1960s to 80,000 fifty years later. 2. Why? Part of American character to want to grow. Growth is good. The antithesis is stagnation. 3. Why is growth good? Because it has economic benefits. And we are steeped in the capitalistic philosophy and tradition 4. For government units, the motivation is to expand a tax base, giving the taxing unit more revenue. More people means more income tax: More building means more property taxes 5. When is last time this city, actually cut taxes? Never. Instead it cuts budgets. Its appetite grows with each year. It justifies that growth by saying, we're growing, we need more policemen, more firemen, more, more, more. You take pride in saying that tax rates have not grown, so that makes it okay. 6. Now this Council takes that same mode of thinking and is expanding it to wit: The city is larger, its budget is bigger, there are more employees, there is more capital investment. Thus councilors need more compensation to "govern" this growth. C c) i r/ C(7 y (4 -r-hcg to ENT CO a nl e t L /Y1 qI I i/ a 8 This is the cycle we've allowed ourselves to fall prey to. As a former councilor serving from. 1976 to 1988, the first big mistake I made was agreeing to change our compensation FROM that of being an independent vendor TO being treated as an employee when it comes to withholding. We did this primarily so we wouldn't have to pay the full FICA on our meager remuneration, but mainly so the Clerk Treasurer would withhold taxes from our checks. That was when we got less than a thousand dollars a year and FICA rates were less then they are today. That was the beginning of this slippery slope that has this present council making $16,120 a year, and costing the taxpayers over $18,000 a year with FICA and PERF contributions. And through deferred compensation, at least one of you is making over $22,000 annually. PERF returns are great severance pay. Now you are arguing because of our size, you deserve more •compensation. You argue: 1. Our budget is bigger. Yes, but you're only talking about zeros. The format of the budget is little changed. Other councils spent the same amount of time honing the same number of line items as you. A rACH[nEN 1 (z.) Maybe we tried to get $500 out of a line item of $10,000, while you try to get $10,000 out of a line item of $200,000. Its only zeros, not time. And let me add, that our first councils forced the mayor to place the city and wastewater utilities on a budget and we had to go through those budgets, which you don't. 2. You don't hire, fire, promote or supervise any employees. So the size of our workforce doesn't affect you. 3. We have a larger capital plant, but the board of works is responsible for monitoring and maintaining that, not you. You merely include it in your budget reviews, the same as we did. If we followed your logic that the larger a government unit is, the more the legislative members should make, members of the Indiana General. Assembly should get over a hundred times as much as you make, and they work fulltime three to four months a year. That would make their compensation $1,800,000 a year. And Congress, which purports to be fulltime should make a thousand times as much as you, which would be $18 million a year a piece. Since the first council of this city got paid a total of $600 a year, your present compensation is 30 fold higher. For 6-7TP cilia t'JT l (s) those who take this insurance package for you and your spouse or family, your compensation will be 50 to 60 fold higher than the first council just 35 years ago. So, that one mistake we made 35 years ago is the little seed that has germinated into this evening's issue. Full time vs. Part time. Citizen's legislature vs. Professional legislature? Public service vs. public employment. Your action will determine how you perceive your role, and you will ultimately be held accountable for it by the public. I have served on some boards and commissions and I do know that while this is a great deal of satisfaction from "missions accomplished" there is also some thankless hard work and thank you for that. I am a property owner on Range Line Road and was on the Plan Commission when the Range Line Road Overlay Zone was sent forth to this body. In those economic times I was all in favor of the stricter requirements of the overlay zone. Unfortunately the economic times have changed and we are not seeing the great growth that Carmel enjoyed then. As matter of fact there has been way too little development in the Range Line Road overlay zone. We all know that the fastest way to economic health is thru development. It creates jobs and energizes many industries that are both closely related and distant. We all want Carmel to be vibrant to redevelop and to continue to become a model for others to follow. The purpose of the sunshine clause on the amendment was put in place for precisely the reason we are discussing it today. We wanted to revisit this issue to make sure that we had done the correct thing. I suggest that we let it expire and let us return to the development standards prior to this overlay zone to see if we can spur development in this important part of our city. This could even be done with a time frame or sunshine clause attached to it so that developers could take advantage of relaxed standards in a time window. The standards that existed were very strict prior to this overlay zone and would still cause the type of development that we all want to see. The DOCS will ensure that there are no trailer parks or adult businesses built but rather just a modernization of our main north south street. Thanks again for your time and all you do.
