'2. o CARMEL/CLAY ADVISORY BOARD OF ZONING APPEALS CARMEL, INDIANA Docket No.: Petitioner: FINDINGS OF FACT- DEVELOPMENT STANDARDS VA.RIANCE The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because' the development will be very Iow density and not have an impact on traffic, density, safety or any other concern of a public nature. The use and value of the area adjacent to the property included.in the variance will not be affected in a substantially adverse manner because: the front setback reduction will not result in structures being built any closer to adjacent properties than as permitted under the Zoning Ordinance. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: - the narrow width of the property, the dedication of right-of-way, and on-site retention all reduce the amount of buildable area, as does the desire to maintain lots that are compatible with the existing development pattern, all leading to difficulty in complying with all sections of the Ordinance. Petitioner seeks a variance of Section 6.04.03(A) of the Carmel/Clay Zoning Ordinance to provide for a front yard setback of 25 feet, 35 foot minimum front yard setback required. The narrow width of the property, and the configuration of the road, which was designed to make the neighborhood compatible with adjoining uses, resulted in small building pads with very large homes proposed.
