FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The petitioner has utilized the existinq parking lot for many years, since the club was opened. It has operated well
without curbing or curbed traffic islands. Installinq curbing or traffic islands now would require that the entire
existinq parking lot be demolished and reconstructed with subsurface and other drainaqe facilities. This would not
benefit the public, and would result in substantial unnecessary expense to the petitioner.

The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The petitioner proposes to construct a new clubhouse, similarly sized and in substantially the same location as the
existing clubhouse, which will not adversely affect either the use or value of property in the area adjacent to the
property included in the variance. Keeping in place, without curbing or traffic islands, the existing parkin~ lot after
this construction will also not adversely affect properties in the adjacent area, since the parking lot will continue to
function as it has, without adverse impacts, for many years

The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The petitioner has utilized the existinq parking lot for many years, since the club was opened. It has operated well

DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. 04020013V is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
