The owner has made significant revisions to the plan to keep the addition out of the easement (including footers and overhangs). The home addition will now not require side yard setback variance approval form the BZA or approval from the BPW to encroach into the easement. As you noted the owner will need approval from the BPW of the proposed driveway cut onto Thunderbird Lane. In this regard we would like to be placed on the agenda of the Board of Works for November 2, 2011. The deadline for placement on the agenda for that date is October 26` Please let me know what information is necessary to submit in addition to the plot plan in order to be placed on the agenda. Engineering does not support encroachments of any part of the permanent structure (footings, footing drains, eaves, overhangs) into easements. Ultimately, it is not our call...that lies with the BPW. Written permission from the adjacent property owner will need to be provided for the portion of the driveway across that property. Curb cut approval will be needed from the BPW for the second curb cut serving the property...is this roadway public right -of -way? The shaded area is 50' by 197' which is close to but just under the maximum 35% (approximately 33 or 34 As you can see all of the improvements (existing and proposed) would fit within the shaded area with significant room to spare. Note: the pool illustrated on the plan is not there unless it was built this summer and is not on the aerial. Either way the improvements are under the 35% cap.
