During our brief discussion concerning this project today you asked to submit the plat
drawing as signed & approved by Carmel, BPW, etc. I have sent this as exhibit "A".
As-mentioned also during our talk, exhibit "B" is showing the 10' sanitary sewer
easement coming onto the site at a different angle (both highlighted, in yellow).
We have re-routed the sanitary sewer on this project due to conflicts between the
developer and adjoining lot owner to the south of Ballantrae, Originally this seWer was
routed in an existing D&U easement along the. Osbom Legal'. Drain. As things
progressed, the lot owner asked to have the. sewer line moved to~ avoid taking out trees,
etc. After several months of "working out the details", the client and lot owner haVe
come to an agreement, with the lot owner granting easement for a new route.
Additionally, the lot owner to the north as also agreed to allow this sewer to cross his
.
tract (as shown on exhibit "C" included) The legal work for this is being prepared by
Charlie Frankenburger.
Therefore, the sanitary sewer is entering Ballantrae at the location as shown on the
' revised'plat ("B"). Since this plat is signed by ali parties, and yet unrecorded, I am
asking your approval to change "Sheet One of Two" 0£ this plat to show the easement of
correct beating. This is the only'change on the plat as. signed.
Sheet Two of Two contains all signatures and would not need any revisions at all. Clay
Township Regional Waste District and IDEM both have knowledge of this change and
are working with Weihe Engineers and the. Anderson Corporation to keep this on track.

· Comments; Jon: Because of the off-sEe sanitary sewer issue we have had
with this project, the route of the sewer is coming in from a different direction (conflict
between developer and ad joiner). There has been an agreement between parties
thus a new location for the sanitary sewer. The plat has been signed by everyone,
including the BPW and is ready for re~rding. A change has been made concerning
the sanitary sewer easement on the drawing of the plat. As shown, the centedine of
the 10' easement comes onto the site 50' from the S.E. comer of the tract on the
original plat (sheet 2 of 3). On the revised plat the easement is 26.71' north of the
S.E. comer of the plat (sheet 3 of 3). This is the only change on the plat and I
wanted to pass this by you before'giving it to client (Anderson Corporation). If you
