RE: The Domain at Legacy Construction Plans- Project Review #1
Dear Mr. Huff:
The City has received the construction plans dated August 22, 2008 that will be submitted to the September
17 meeting of the Technical Advisory Committee. We offer the following comments:
GENERAL INFORMATION
1. These comments represent the Department of Engineering's first review of the construction
plans for this project.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off -site easements necessary to install utilities to serve the development are secured.
e. SWPP is approved.
f. All fees are paid.
6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Storm Water Management Permit is required prior to commencing any earth
disturbing activity.
8. An approved right -of -way permit is required prior to commencing any work in the public
right -of -way.
9. If it will be necessary to relocate existing utility poles, they must be relocated to within one
foot of the proposed right -of -way. Costs for such relocations are to be borne by the
developer.
10. Compliance with the Thoroughfare Plan includes construction of the improvements
prescribed by the Thoroughfare Plan across the frontage controlled by the development
(including sections with no access). Typically, developers provide a commitment equal to

the value to construct these improvements for deposit into the City's non- reverting
thoroughfare fund. Credit is typically given towards this commitment for any widening,
milling and resurfacing of the perimeter streets.
11. The Department requires that the construction drawings be developed in accordance with the
City of Carmel digital submission standards and that all required submittals for primary plat,
secondary plat, and construction drawings be made. The digital files must be submitted to
the Department of Engineering prior to the approval of the construction plans. Please contact
the City GIS Department for the requirements.
12. Jurisdictions:
a. The project site is located within current City of Carmel Corporate Limits.
b. Streets and Right of Way Interior streets and alleys are designated as private streets and
alleys.
c, Water City of Carmel Utilities
d. Sanitary Sewers City of Carmel Utilities
e. Storm Sewers /Drainage City of Carmel.
f Legal Drains Hamilton County Surveyor's Office.
13. Drawings submitted for approval:
a, The design engineer must certify all drawings submitted for final approval.
b. Assuming dual approval by the City of Carmel and by the 1°Iamilton County Surveyor's
Office, we will require a minimum of 11 sets of certified construction drawings for
approval after all issues have been resolved. The drawings will be stamped as approved
and signed by the City Engineer, by Carmel Utilities and also by the Surveyor's Office.
The Owner will receive 3 sets, 1 of which must be maintained on the construction site at
all times_ If the project is strictly City of Carmel approval, a total of 9 sets will be
required.
14. Carmel Utilities will provide separate reviews of this project for water and sanitary sewer
issues. Please assure that copies of all drawings are sent to:

Failure to provide Carmel Utilities with all revisions may result in the delay of approval of
the final construction drawings and delay of project approval.
15. Carmel Utilities does subscribe to "Holey Moley" who should be contacted directly for all
water main locations.
16. Upon request the following items will be sent electronically regarding this correspondence
and project:
a. Project Approval Checklist
b. Performance /Maintenance Guarantees
c. Street Signage
d. Utility Jurisdictions /Right of Way Permits
e. Availability (acreage) Fees
I3OARD OF PUBLIC WORKS AND SAFETY
17. A schedule for Board of Public Works and Safety meeting dates and agenda deadlines has
previously been sent electronically for your use. Please use the Engineering Department
deadlines for submissions to the Board.
18. Any submission to the Board requires prior approval by the Carmel Clay Plan
Commission and /or the Board of Zoning Appeals (if applicable) and completion of
review by the Technical Advisory Committee. All written requests to be placed on the
Board's agenda must include the appropriate Docket Number and the date (or dates) of
approval by the Plan Commission and /or the Board of Zoning Appeals (if applicable).

19. Water and Sewer Availability approval from the Board will be required. This is an EDU
approval and the EDUs have not been determined at this time. What type of residential
and /or commercial development is planned for this project'? Please reference items #34, #35,
#36 and #37 for additional details.
20. Commercial Curb Cut Approval Since the streets have been designated as private streets,
BPWS curb cut approval will be required. This would apply to the private drive curb cut on
Community Boulevard and on Cherry Creek Boulevard.
21. Temporary Construction Entrance approval if the location is at a site other than the location
of the proposed permanent entrance to the development.
22. The installation of any permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated
easements requires the execution of a Consent to Encroach Agreement between the Owner
and the City of Carmel. Such agreements are executed by the Board of Public Works and
Safety. The City Engineer may approve irrigation system agreements.
23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to
submission of secondary plats for Board of Public Works and Safety approval.
24. Dedication of Right of Way if not platted. Do you intend to dedicate the right of way for the
portion of Cherry Creek Boulevard adjacent to the project prior to construction? The rights
of way of Community Boulevard and the Community Drive /Cherry Creek Boulevard
roundabout were dedicated previously.
25. Any open pavement cuts of the existing Community Boulevard and /or the roundabout will
require Board approval.
BONDING REQUIREMENTS
26. Upon initial review, it appears performance guarantees shall be provided for the following:
a. R/W Improvements (curb cuts)
b. Water Mains onsite and offsite)
c. Sanitary Sewers
d. Street Signs. Since the streets are designated as private streets, performance guarantees
will not be required. Installation and maintenance of street signs will be the
responsibility of the Developer /Owner /HOA.
e. Monuments Markers. Since the streets are private, perimeter monumentation will be
the only Monument Marker bonding requirement for this development
f. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley,
Engineering Department Stormwater Administrator, for details regarding engineer's
estimates /performance guarantee requirements for these items.
27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cost of labor and materials to construct the individual improvements, to be
provided by the design engineer. Please provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc. The estimates
need to be provided to this office at the sane time that they are provided to the developer to
allow us adequate time for review prior to submission of performance guarantees.
28. Upon completion and release of individual Performance Guarantees, a three -year
Maintenance Guarantee will be required (see Street Sign comments above). The
Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets
and Curbs and 10% of the Performance amount for all other improvements. Erosion Control
maintenance amounts will be determined by Amanda Foley or John Thomas of this office.
29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of
Credit.
30. Please reference the enclosures for more detailed explanation of our procedures.

RIGHT OF WAY PERMIT AND BONDING
31. Any work in the dedicated right of way of Community Boulevard and /or the Community
Boulevard/Cherry Creek Boulevard roundabout will require an approved Right of Way
Permit and a License Permit Bond.
32. The bond amount is determined by the number of instances of work in the right of way as
determined by the Right of Way Manager. However, if the work is included in the scope of
work of a required and posted Performance Guarantee, the Performance Guarantee may be
used to satisfy the bond requirements of the Right of Way Permit.
33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting
and bonding.
AVAILABILITY AND CONNECTION FEES
34. Availability (acreage) Fees must be paid after all other Engineering Department requirements
have been satisfied and prior to approval and start of construction activities. Availability Fees
are based upon total platted acreage or legal description acreage for the development at the
current rate of $1,010.00 per acre for Water Availability and $1,365.00 per acre for Sanitary
Sewer Availability. However, these fees are subject to change. Based upon the platted
acreage of 5.464 and upon current fees, preliminary estimated Availability Fees are:
Water 5.464 Acres $1,010.00 /Acre 8 5,518.64
Sanitary Sewer 5.464 Acres X17, $1,365.00 /Acre 7.458.36
Total 5.464 Acres $2,375.00 /Acre $12,977.00
Please note effective October 6, 2008, the Water Availability Fee will be increased to
$2,020.00 per acre. The current Development Application Review Fee will not be increased.
This fee is paid with the payment of Availability Fees and will be a total of $300.00 for this
development.
35. Connection (EDU) Fees are based upon single family residences. These fees are paid with
the submission of applications for building permits. The current Water Connection Fee is
$1,396.00/1.0 EDT) and the current Sanitary Sewer Connection Fee is $795.00/1.0 EDU, both
of which are subject to change, Please provide this office with the type of residential housing
proposed for this development (single family detached, townhomes, etc.). Please note that
effective October 6, 2008, the Water Connection Fee will be increased to $2,615.00 per
EDU. The current Water Tap Inspection Fee of 886.00 per EDU will not be increased
36. We suggest that the developer contact John Duffy of Carmel Utilities to determine the timing
of proposed water fee increases (and future sanitary sewer fees) and how the increases will
be applied to this development.
37. If an entryway irrigation system, other community irrigation system, community swimming
pool, community clubhouse or community bath house is planned for this development,
additional Water Availability Fees and Water Connection Fees (and Sanitary Sewer
Availability and Connection Fees if applicable) will be assessed based upon the size and
usage of the system and upon the recommendations of the Director of Carmel Utilities.
SECONDARY PLAT REVIEW COMMENTS
38. Why are perimeter monuments not indicated on the secondary plat?
CONSTRUCTION PLAN REVIEW COMMENTS
39. General Comments
a. This project is subject to the City's Storm Water Manangement and Storm Water Quality
Ordinances,
b. Please contact Amanda Foley to review storm water quality /treatment requirements.
40. On Sheet C501, sanitary structures #743 and #745 are incorrectly identified as 843 and
#845on the profile portion of the sheet.

41. The primary plat submitted July 18, 2008 indicated that Solsbury Hill Drive is a private
street. Please either indicate on the Secondary Plat and all appropriate sheets of the
construction plans that Solsbury Drive is private or revise to City of Carmel standards.
42. Please indicate and label the right-of-way of Community Boulevard on all appropriate plan
sheets.
43. Please indicate and label the curb return radii at the intersection of Cormunity Boulevard
and Solsbury Hill Drive. The curb return radii shall be a minimum of 30 feet.
44. At the intersection of Community Drive and Solsbury Hill Drive there is a gap in the curb on
each side of Solsbury Hill Drive. There must be curb within the public right -of -way, Please
include the City of Carmel curbing policy within the plans.
45. On the cover sheet, please provide a larger scale drawing of just The Domain at Legacy
rather than a small scale drawing of all of the surrounding development. The word
"LOCATION" is misspelled in the "PROJECT LOCATION" label.
46, On Sheets C700 and C701, the word "INSTALLATION" is misspelled.
47. On Sheet C801, please revise the note to contractor so that it is the same as the note to
contractor on Sheet C802.
