Dear Mr. Huff.
The City has received your comment letter and drawings dated October 14, 2008 based upon the City
review of September 25, 2008.
The comments from the City review have been satisfactorily addressed with the following exceptions:
CONSTRUCTION PLAN REVIEW COMMENTS
41. The primary plat submitted July 18, 2008 indicated that Solsbury Hill Drive is a private
street. Please either indicate on the Secondary Plat and all appropriate sheets of the
construction plans`that'Solsbury Drive is private or revise to City of Cannel standards. It
has been noted that the name of Solsbury Street has been changed to Antiquity Drive.
On Sheets C400,'C401, and"C60I, Antiquity Drive is labeled "PRIVATE STREET" in
two locations and "PRIVATE ALLEY" in athird location. Please change the
"PRIVATE ALLEY label to "PRIVATE STREET" on these three sheets and any
other sheets where this has occurred.
Based on additional review, the Department provides additional comments.
1. Since the initial submittal for this project, the plat has been modified to result in Section 1
and Section 2..Is Section 2 comprised only of lots 16 -20? Please label these two sections
appropriately on sheets within the construction plans. Please understand that approval of the
construction plans will require payment of all fees and provisions of aU performance bonds
for everything included within' the construction plans (Sections 1 and 2).
2. Please continue to work with Crossroad Engineers to resolve all of their drainage review
comments.

Dear Mr. Redden:
I am sending you a set of revised Construction Plans, Final Plat and
supporting documents for the above referenced project in response to your
comment letter dated September 25, 2008.
CONSTRUCTION DRAWING REVIEW COMMENTS
41. The street names have been revised per the approved list for The Legacy
development per Bill Akers. Also, we have denoted all streets in this
project to be private on the Plat Cover Sheet and appropriate sheets in
the plans.
42. The right -of -way width for Community Drive has been previously
approved in the PUD for this project and a right -of -way dedication has
already been recorded along with the approved Construction Plans for
The Legacy Master Infrastructure, Phase One. I have attached a copy
of the street cross section from the PUD for Community Drive which
denotes a 48' right -of -way.
43. There will be no curb for the return radii at the intersection of
Community Drive and Antiquity Drive. However, we did revise and
label the pavement return radii to be 30'. Also, I spoke with Gary

due to the 10' asphalt path that will need depressed curb on both sides of
this entrance.

Report which have been revised in accordance with your review e -mail dated October
3, 2008. Those comments were addressed as follows:
1. I have included with this submittal a Petition for Reconstruction for the
Tunis Garard Drain. As you mentioned, an outlet permit has already been
provided. An Engineer's Estimate and bond will be sent before the
preconstruction meeting on this project.
2. A temporary 15" HDPE pipe will be installed to pick up the drainage from
the open ditch proposed for reconstruction of the Legal Drain. This pipe
will outlet back into the existing 15" tile and make sure the drainage
remains within the Legal Drain tile system. Any overflow is designed to
go into the 7" existing tile to the East just North of the future Cherry
Creek Boulevard as you suggested.

material, point of connection, lot lines, buildings, physical features and platted
easements right -of -ways and any other information required by the Surveyor's
Office.

A. The storm water quality measures included in the Construction Plan comply with the requirements of 327 IAC 15- 5 -6.5, 327 IAC 15 -5 -7, and 327
IAC 15- 5 -7.5;
B. the storm water pollution prevention plan complies with at applicable federal, state, and local storm water requirements;
C. the measures required by section 7 and 7.5 of this rule will be implemented in accordance with the storm water pollution prevention plan;
D. if the projected land disturbance is One (1) acre or more, the applicable Soil and Water Conservation District or other entity designated by the
Department, has been sent a copy of the Construction Plan for review;
E. storm water quality measures beyond those specified in the storm water pollution prevention plan will be implemented during the life of the permit if
necessary to comply with 327 IAC 15 -5 -7; and
F. implementation of storm water quality measures will be inspected by trained individuals.
In addition to this form, I have enclosed the following required information:
Verification by the reviewing agency of acceptance of the Construction Plan.
Proof of publication in a newspaper of general circulation in the affected area that notified the public that a construction activity is to commence,
including all required elements contained in 327 IAC 15 -5 -5 (9). The Proof of Publication Must include company name and address, project name,
address /location of the project, and the receiving stream to which storm water will be discharged. Following is a sample Proof of Publication:
