PROJECT OVERVIEW
Kite Development Company has filed a Developmental Standards Variance application for the four
restaurants to be located at the southeast corner of 146th Street and Keystone Avenue, just south of
the existing Lowe's building. This property is located in a Planned Unit Development (PUD) district
that includes the Lowe's location. The restaurants have been designed in compliance with the PUD
district development standards with the exception that the minimum height of the restaurants is 25
feet instead of 30 feet.
Abuelo's has been designated for one of the four restaurants with specific ADLS plans approved by
the Plan Commission. The building elevations for Abuelo's have been provided as the sample of the
25-foot height for all four of the restaurants. Specific plans for the other three restaurants will be
filed at a later date. The landscaping and lighting are proposed to be consistent among all four
restaurants.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
the minimum height established by this variance will ensure that the height of the restaurants will conform to the
approved building design adopted the Carmel/Clay Plan Commission.

The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the variance establishes the criteria and guidelines approved by the Plan Commission in consideration of the use
and value of the adjacent area and properties.

The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
the zoning ordinance as amended by Z 344 is not in conformance with the restaurant design specifically approved
for this development project thereby creating an ambiguity that needs to be removed by this variance.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein' by reference and made a part hereof.
