Mayor Brainard called the meeting to order at 6:00 p.m.
Carmel Police Chaplain, George Davis, pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Snyder made a motion to approve minutes from the October 3, 2011 Regular Meeting.
Councilor Rider seconded. There was no Council discussion. Council President Seidensticker called for
the vote. Minutes were approved 5 -1 (Councilor Griffiths abstained, Councilor Carter not present).
Councilor Carter entered the Council Chamber.
Without objection from the Council, Council President Seidensticker requested that Item 10 (c) be moved
to this place on the agenda. There were no objections from the Council.

Bates Mclndoe, 4832 Skipping Rock Court, Cannel, IN, representing Bayhill Homeowners Association,
addressed the Council opposed to the power transmission lines being installed by Duke Energy, along
Gray Road from 116 Street to 126 Street

Councilors Accetturo, Griffiths, Seidensticker and Snyder addressed Mr. Mclndoe.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Griffiths made a motion to approve claims in the amount of $1,493,326.61. Councilor Snyder
seconded. There was brief Council discussion. Nancy Heck, Director of Community Relations,
addressed the Council. There was brief Council discussion. Clerk- Treasurer Diana L. Cordray, addressed
the Council. Council President Seidensticker called for the vote. Claims were approved 6 -1 (Councilor
Carter was not present).
Detail of Wire Transfers for August, 2011. Councilor Griffiths made a motion to acknowledge wire
transfers in the amount of $1,231,611.84. Councilor Sharp seconded. There was no Council discussion.
Council President Seidensticker called for the vote. Wire transfers were acknowledged 6 -0.

COMMITTEE REPORTS:
Councilor Snyder reported that the Finance, Administration and Rules Committee had not met. The next
meeting will be held on Thursday, October 20, 2011 at 5:30 p.m.

Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee had not
met. The next meeting will be held on Tuesday, October 25, 2011 at 5:30 p.m.
Council President Seidensticker reported that the Parks, Recreation and Arts Committee had not met.
Councilor Griffiths reported that the Utilities, Transportation and Public Safety Committee met and
discussed Ordinance D- 2055 -11 which was referred back to the Council with a positive recommendation.
The Committee also discussed Ordinance D- 2061 -11 which remains in committee.
Dave Bowers, Council representative on the Cannel Redevelopment Commission, was available for
questions of the Council regarding the financial activities of the Carmel Redevelopment Commission.
There was brief Council discussion regarding the leaks in the Sophia Square parking garage.

CRC Meetings
CARMEL REDEVELOPMENT COMMISSION
October 3, 2011
CITY COUNCIL REPORT
(Prepared for David Bowers and Brad Meyer 9/21/11)
The CRC held their regularly scheduled public meeting on Wednesday, September 21 at 6:30 p.m.
Upcoming Meetings:

o Wednesday, October 19, 2011 at 6:30 p.m. Regular Meeting
Financial Matters:
The end of month August CRC Operating Balance is $1,038,839
CRC Public/Private Partnerships:
1. City Center CRC/Pedcor LLC (Parcel #5)
a. Please see attached report from Signature Construction (Distributed at 9/21/11 CRC meeting).
b. Bids for Veterans Way Street plantings, bollards, street lights and benches were reviewed by the
Construction Manager and brought to the CRC for review and consideration. The CRC
approved the contract, subject to available funding, and contracts are being written.
c. The CRC staff is working with Pedcor to determine how to proceed forward with the way
finding signage for Veterans Way and the Motor Court.
d. The Motor Court Exterior wall contract is being reviewed and discussed by the Finance
Committee and was released August 1, 2011 for construction.
2. The Palladium (Parcel #7 -A)
a. A "rework" of the west exterior signage for the Palladium is being finalized and hopefully will
all be installed by the end of October.
b. The green roof has been installed at the north roof with finishing touches being completed.
Final coordination of the green roof and landscaping along the streetscape is being coordinated
by the landscape architect of the City Street Department.
c. Bids for the landscaping around the Palladium were reviewed by the Construction Manager and
brought to the Commission for their review and consideration. Bids were rejected for being
over budget. Construction Manager will re -bid the work in separate packages. The CRC staff
is working in coordination with CSO Architects and Shiel Sexton on the limestone planter bid
package and will bring results at the next regular CRC meeting.

3. Center Green (Parcel #7 -B)
a. Trash cans and benches are on site at the Green. Skate Board "stoppers" are being installed on
the benches and this should be completed by 9/23/11.
b. Final punch list items are being completed.
4. Energy Center Piping Extensions to City Buildings (Parcel #7 -C)
a. The final underground work will be completed by the middle of October. This is still on
schedule.
b. The IT Department will temporarily relocate to Suite #250 in the Lurie Building during the
remodeling of their space on the 3rd floor of the Police Station. The ceiling on the 3rd floor is
poorly insulated and this is causing heat to escape in the winter and vice versa in the summer.
c. Work in City Hall has started with work beginning in the HR Department and half of the
Engineering Dept on 9/19/11. According to the project manager, work is going very smoothly
in the Fire Department. We hope that this continues on all buildings.
5. Main Stage Theater CRC, REI, Pedcor LLC and Signature Construction (Parcel #7C -1)
a. The Tarkington Theater is complete and opened! Civic Theater has moved into their new office
space.
b. Interior signage will be installed in the first week of October. Parking Garage redesign is
complete and the contractor is pricing.
c. Punch list items are being worked on and are nearly complete.
d. Miscellaneous equipment is being procured by the CRC staff at the direction of the Finance
Committee.
6. Arts District Lofts Shoppes CRC /Keystone Development (Parcel #47)
a. Streetscape work is 98% complete. Light pole installation and caulking of joints is mostly all
that remains.
b. Due to an error with the concrete pour, grinding in the courtyard is ongoing. The contractors
will grind down 3 -6" of concrete in order to properly install the rubber water proof membrane
and brick pavers. This will make the garage "weather tight
c. The work on the fountain within the courtyard is underway. Hopefully this will be substantially
complete by the middle of October.
d. Huddles Frozen Yogurt, Adara Day Spa and Cafe St. Tropez have recently opened within this
project.
e. The Monon Trail stairs on the east side of the trail are open and operational. 2nd Ave NW is
nearly completed.

f. Bids are being received for the redesign and rework of the west side of the Monon Trail.
g. Dave Littlejohn of the City of Carmel is reviewing the bike plan and will recommend locations
for bike racks on the streetscape level. A total of 10 racks are required within the parking
garage.
Marketing Public Relations Update:
1. News and Events
a. The second edition of the CRC newsletter was distributed to all households in Carmel at the
beginning of September.
b. Upcoming Arts Design District events include:
i. Saturday, September 24, 10 a.m. 6 p.m. and Sunday, September 25, 10
a.m. 5 p.m. Carmel International Arts Festival
ii. Saturday, October 8, 5 -10 p.m. IU Health North Hospital Gallery Walk
c. Members of staff are working in partnership with the City on preparations for select upcoming
events, including the Oktoberfest event in Merchant's Square as well as the Veteran's Day
Ceremony. Oktoberfest will take place on Friday, October 14 and feature a performance by
Polka Boy as well as food, drinks and activities from local merchants. The Veteran's Day
Ceremony will take place on Thursday, November 10, 12:00 p.m. at Tarkington Theater to
honor local veterans.

Signature Construction is pleased to provide a brief list of highlighted activities being
completed in Carmel within the last month for the P111 Waterproofing and Pavers,
Parcel 73 Streetscape, Village on the Green Theater, Parcel 5 Motor Court Brick Veneer,
Parcel 5 P112 Site Amenities and Tenant information at Indiana Design Center as well as
Cannel City Center Buildings A B.
1. Parcel 73 Streetscape Project
The closeout documents are being prepared.
A site inspection was completed for project closeout. All contractors will
begin punch list items as soon as it's received.
2. P -111 Waterproofing, Mud Slab and Pavers
The Motor Court pavers will complete next week.
The Hanover Square fountain is installed. Paver installation will begin next
week and the fountain will be operational by tuid October.
The Motor Court fountain feature is complete.
3. Parcel 5 Motor Court Brick Veneer
The submittals for the base bid {exterior wall) and Alternate 01 (west wall) are
with the architect. Once the submittals are approved, installations will begin.
The contractor confirmed that the brick material is ready to ship.
4. Parcel 5 P11.2 Site Amenities
Light pole layout is complete. The process for coring the conduits through the
plaza Ievel will begin.
Precast planters have arrived. The contractor is shipping more this week and
all planters will be on site by the end of the month.
Signage submittals are with the architect.
5. Village on the Green Theater Parcel 7C -1
This project is complete and turned over to the owner.
e Punchlist items continue and will complete this month.
6. Indiana Design Center Tenant Spaces
The total leasable square footage for Indiana Design Center is 82,975 square
feet. Currently, 74,685 square feet is leased.
7. Carmel City Center Tenant Spaces
The total leasable space for Carmel City Center Phase 1 is 78,427 square feet.
Currently, 25,818 square feet is leased.

THE- GROUND POWER TRANSMISSION LINES North
Along Gray Road From 116th. to 126th. Streets' I I I

Mayor Brainard and City of Carmel Council Members:
I am Bates Mcindoe and I live at 4832 Skipping Rock Court
in the Bayhill Sub Division near 126th. and Gray Road. My
property backs up to Gray Road where Duke Energy wants
to install 60' to 75' High Poles with up to 13 Cable Strands
up -in -the air carrying 69,000 Volts overhead from 116th.
Street to 126th. Street! Duke Energy wants to install these
tall poles and cables on the East Side of Gray Road 25 feet
from my property line and 10 feet in from the edge of the
pavement of Gray Road on the easement! I am speaking
for myself as a property owner, and I DO NOT WANT
THESE POLES AND ABOVE- THE GROUND POWER
TRANSMISSION CABLES INSTALLED RIGHT NEXT TO
MY PROPERTY!!!! I have talked with THIRTEEN of my
neighbors in Bayhill who are on Skipping Rock Court and
Heatherstone Place whose properties back up to or look
over to Gray Road. They are ALL with me on this on not
wanting these Poles and Cables Installed Along Gray Road!
I plan to talk with more of our neighbors about this after this

Meeting!
To give you members of the Council some background on
this, our Waterstone Homeowners Association found out
about Duke Energy's plans to do this in late August due to a
walk through by Mike Holillibaugh Carmel Planning and
Zoning Director and people from Duke Energy on August
29th. during which Duke Energy described their plans to
remove a lot of trees and foliage along the East Side of
Gray Road starting October 1st. and installing the tall poles
and overhead cables.
Our Waterstone Homeowners Association includes the
Bayhill, Brookfield, Windpointe, and Stonewick sub- divisions
562 homeowners and all the utilities are underground in
our areas!!!
Our Waterstone Homeowners Association appointed a
three member Committee of Council Members to study this
Duke Energy Project and make recommendations. After an
extensive study and meetings with Mike Hollibaugh, Michael
McBride City Engineer, and others; the Committee
requested an emergency meeting with Mayor Brainard and
he met with them on September 27th. Also attending that
meeting were Luci Snyder, our new City Councilwomen who
is representing our area, and a representative from the City
Engineer's Office. Thank You, Mr. Mayor, for meeting with
them!
Also, as an aside, Mr. Joel Rust, a respected Realtor in the
real estate business who lives in Bayhill and is a Waterstone
Councilman sent the following e-mail to Mayor Brainard on
September 24th.: "I wish to thank you for your involvement
with this issue that we are now faced with. As a 17 year
resident of Bayhill at Waterstone and also a longtime

Realtor of our wonderful community, the poles and the
power lines will have an adverse impact to the residents that
live on Skipping Rock Court and also along Heatherstone
Place and also not to mention the loss of the trees that act
as a buffer for those homes as well. Thank you for your

I have since contacted my Realtor who works for Scheetz
Century 21 here in Carmel, and she fully agrees with Joel
Rust! She is concerned that the Above -The- Ground Power
Transmission Lines proposed to go in along the East Side
of Gray Road will hurt our property values and will harm the
possibility of the re -sale of our homes along Gray Road!!!
Continuing on, the results of that meeting with Mayor
Brainard on September 27th., reported by our Waterstone
Committee, were that Mayor Brainard said that the City of
Carmel cannot dictate what Duke Energy has to do, they
are the 900 Pound Gorilla, and they can do what they want
to do on the easements They are a Monopoly here in
Indaiana. Mayor Brainard said that he sympathises with our
Waterstone Committee's concerns about our property
values, the safety issues of the electrical emissions from
those 69,000 Volt above- the ground power lines, etc. and
knows that we want to have the cables installed
underground. Mayor Brainard said that he would contact
Duke Energy and the Indiana Utility Regulatory Commission
to request a delay in this Project. Also, Luci Snyder told our
Committee on September 27th. that she would work with
you on the City Council to draft a new Ordinance to require
that Utilities install all future Power Transmission Lines
underground in Carmel.

Regulatory Commission, and they have agreed to delay the
start of this Project until the end of November. THANK
YOU, MR. MAYOR, for doing this'll! Also, it was reported
that Luci Snyder is not going ahead with the Ordinance
because "it is not the proper timing to do this." What does
this mean and where does this leave us property owners on
Gray Road?
OK, this is where we are now, as far as I know.
Now, speaking for myself only and my thirteen neighbors, I
have the following questions /comments which I e- mailed to
you Mr. Mayor, on September 24th. and September 25th.
and I copied Luci Snyder and Mike Hollibaugh to which I
have not receive any definitive replies from any of these
people I just mentioned nor has our Waterstone
Homeowners Committee. This is the reason I am speaking
with you tonight! I would like to receive replies with complete
answers to the following which are excerpts from my
e- mails:
1. Are there underground power lines now installed
underground that run from the Waterstone Entrance North
on Gray Road to 126th. Street? There are only small above
the ground lines of some sort that run from the Waterstone
entrance in the trees along the East side of Gray Road up
to about the Bally Circle entrance and NO above the ground
power lines North from there to 126th. Street along the East
Side of Gray Road. AND, NO above- the ground line /cables
on the West Side of Gray Road from the Waterstone
entrance to 126th. Street. NO above the ground power lines
at all! And now, Duke Energy wants to cut down the trees

3. I do want an answer from Mike Hollibaugh or you about
the safety issues of these Transmission Lines that I raised
in my e-mail to Mike Hollibaugh on September 24th, I
asked: "Isn't an Environmental Impact Study required when
Electrical Power Transmission Lines are run over or very
near residential neighborhoods? We are very concerned
about the electrical emissions that could emanate from
these above ground power lines and what would be their
effects on our residents, especially our children who live
here and will be under these Power Lines. Will the above
ground power transmission lines be properly shielded to
protect our residents? Wouldn't the best, safest option be to
run them underground
4. I (we) would like to know who to contact at the Indiana
Utility Regulatory Commission to voice our concerns about
these proposed Duke Energy Power Transmission Lines
that they want to install along Gray Road above or very near
to our residential neighborhood. I will also ask them why
Public Hearings were not held on this issue and why an
Environmental Impact Study is not legally required to be
conducted for Transmission Power Lines Projects in
residential neighborhoods like this. Please send me (us)
information on who to contact at the Indiana Utility
Regulatory Commission. Are there any other State of
Indiana Departments or people we should contact? Your

You now know my strong feelings about not letting Duke
Energy run above- the ground Power Transmission Lines
the 0.4 Miles from the Waterstone Entrance on Gray Road
along the East Side of Gray Road to 126th. Street. (I have
driven along Gray Road and noted that there are Power
Transmission Lines now installed above the ground most of
the way from 96th. Street to 116th. Street AND 126th Street
to 146th. Street on the WEST SIDE OF GRAY ROAD. Why
does Duke Energy want to run their Power Transmission
Lines on the EAST SIDE OF GRAY ROAD in our area near
our homes in Waterstone Also, there appears to be less
homes on the West Side of Gray Road because of the
commercial area (The O'Mallia's Shopping Center and the
PNC Bank at the Corner of 126th. and Gray Road) along
Gray Road. There also seems to be wider land available on
the WEST SIDE of Gray Road for these Power
Transmission Lines.
As you can see, me and my neighbors DO NOT WANT
DUKE ENERGY TO CUT DOWN THE TREES AND
FOLIAGE ALONG THE EAST SIDE OF GRAY ROAD AND
INSTALL THOSE UGLY POLES AND POSSIBLY
DANGEROUS ABOVE- THE GROUND POWER
