Dear Sir or Madam: This letter is being provided to inform you that it has recently been brought to the City's attention that the exterior of the structure at 10491 Commerce Drive, a property listed under your ownership, has been altered without Plan Commission approval. This property is zoned B3, a business district. As per §14.00.02.B of the Carmel Zoning Ordinance... Architectural Design, Exterior Lighting. Landscaping and Signage. To insure the compatibility of the proposed use with adjoining areas, the Commission shall review the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) application of any proposed use of any Lot or parcel of ground within the B-3 District prior to the issuance of an Improvement Location Permit by the Department. Once approved by the Commission the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) shall not be materially or substantially changed or altered without the prior approval of the Commission. This location received ADLS approval in November, 2005. The alterations, which were recently made to the structure, specifically the outdoor seating area at the southwest corner of the subject structure, are not consistent with the approved exterior. As such, the changes require an ADLS j Amendment to be permitted. Please contact Angie Conn, Planning Administrator, at (317) 571- 2281 for more information and the process for applying for the ADLS Amendment. Please either restore the exterior to the original condition/design or apply for an ADLS Amendment by November 17, 2008. Failure to comply will result in further enforcement action. According to Section 25.07.01-4 Prohibited Signs, of the Carmel/Clay Zoning Ordinance the following sign(s) are prohibited: (f) Signs consisting of banners, posters, pennants, ribbons, streamers, strings of light bulbs, spinners or similar devices, unless they are permitted specifically by other sections of this Ordinance. This letter shall serve as the first and final warning for this type of violation. Please remove the illegal sign by October 31, 2008.
