Fund 699 Non-Reverting Solid Waste FundORDINANCE D- 2077 -11 SPONSOR(s): Councilor(s) Sharp and Snyder AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADOPTING AND ADDING TO CARMEL CITY CODE CHAPTER 2, ARTICLE 4, SECTION 2 -139, ESTABLISHING A NON REVERTING SOLID WASTE OPERATING TRANSFER FUND #699 WHEREAS, the City Utility is required to establish a Solid Waste Operating Transfer Fund to provide for the collection and dispersement of funds from the City trash and recycling program; and, WHEREAS, there currently exists no specific fund which allows for the collection of a twenty -five cent (.25) administrative fee and the payment to the "City's" Solid Waste Contractor for their services; and NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1: The foregoing Recitals are fully incorporated herein by this reference. Section 2: That Chapter 2, Article 4, of the Carmel City Code is hereby amended to add a new Section 139 which shall read as follows: "Sect. 2.139. Non Reverting Solid Waste Operating Transfer Fund #699 There is established a Non Reverting Sold Waste Operating Transfer Fund #699 to be used exclusively for the (a) collection of Solid Waste customer fees for the City of Camel's Solid Waste program, and (b) payment to the "City's" Solid Waste Contractor per the contractual agreement with the City of Carmel. Section 3. That the remaining provisions of Carmel City Code Chapter 2, Article 4 are not affected by this Ordinance and remain in full force and effect. Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 5. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor and such publication as is required by law.
