15-16h. Earl and Bertha Harvey's Subdivision, Lot 2 (Lot 2B)
The applicant seeks approval of the following development standards variances:
Docket No. 04030020 V Ch.7.04.02 lot area
Docket No. 04030021 V Ch.7.04.03 lot width
The site is located northwest of Westfield Boulevard and E. 110th St. The site is zoned R-l/Residence.

General
Information:
The petitioner

Background
Information-.
The petitioner has
also submitted a
primary plat
amendment and secondary plat applications to be reviewed by the Plan Commission.
Analysis'.
The petitioner has a situation where the existing home does not allow the lot to be split per the
requirements of the Ordinance. The variances will be for 4,548 s.f. For the lot area and 20.69 feet for
the lot width of the new proposed lot. The area where the lot is located is one where the homes are
situated on smaller, quaint lots. The approval of the lot split will be in line with the character of' the
neighborhood, in regards to parcel size. The Department would like the petitioner to prove that
there will be sewer and water hook-up to the new lot.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because: The creation of the new lot will allow a
house to be build on an otherwise vacant piece of land.

affected in a substantially adverse manner because'

adverse manner by allowing a slightly smaller lot and slightly narrower lot. The new lot will
ensure that this neighborhood is strong, with the building of a new home in its boundaries.
The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:

the property due to fact that the owner will not be able to split his lot and sell it to another
person to build a home on it.
Recommendation:
The department recommends positive consideration of Docket No. 04030020 V and 04030021 V.
