We would not be in favor of the garage door facing the West, only in this configuration is the sightline adversely affected. I've got two strikes against me, and my meeting went ok with architectural committee last night, I think riley will consider being neutral if I can cut my garage down to being only a few feet over set back instead of 7.5. I have seen a few things on the south side that we were told could not happen in our neighborhood when we purchased our home in 1997; i.e., all garages would not be able to be seen as you entered from Sprlngmill, all homes would be custom built, etc. Since the rules have already been broken,.. I do believe the one strongest Issue would be, what happens with the next variance request; will the next person want 10- 15 feet etc, etc. We have to have the ability to be flexible, yet not too flexible. In your situation, I feel we need to be flexi01e. The zoning department r~mmended a negative consideration of the request for a variance, coupled with a letter from the Spring Lake Estate HCA opposing the request will make it tough to build our house on lot 38. The board considem their recommendations, but I get an opportunity to refute their findings and make my case. Besides the HOA's letter, the zoning department seems most concerned with the lot adjacent to the east owned by tho Wirth's, and the effects It possible would have on that property. Their findtngs go on to my that the encroachment of garage will not bo injurious to the community because it will break the sight line. The Wlrth's have pledged their support to our home plans and will write a letter of endorsement. I ask that you mad my attached letter sent to the HCA and Architectural Committee's (AC) that we received no responses back from yet. If you feel that our home would be a step in the right dlrecl~n for development along Sprfn.qmill Road, I encourage you to reply back to me with a re.,~pon.,m and your address so I can present It at my meeting next Monday. Townsend Hearing Date' April 26, 2004/Request For Variance of Front Setback Gentlemen: My wife and I are the owners of Lot 19 which has built upon it one of two houses that predate the platting of the subdivision. The subdivision was platted with a plat restriction of a front Building Line Setback of 35 feet applicable to all forty-four (44) lots and to my knowledge all 32 existing houses comply without amending the plat or requesting a variance. We would like to express our objection to the proposed variance for the same reasons as the association has objected but we would also like to add several observations of our own. The thirty-five (35) Front Building Setback is shown on the plat, is therefore a restriction on each lot that runs in favor of and benefits each lot owner and is enforceable by each of them individually. (See also Article IX, Section 2 of Covenants). Additionally, the Declaration of Covenants gives to the.owner's association through its Architectural Committee the fight of approval of the design and location of any house. It is my understanding that as of this date a complete set of plans/drawings showing the design and location has not been provided to the committee. My wife and I have not been contacted to waive our personal fight of enforcement of the front setback restriction and presume no other property owner(s) has been contacted. It would appear to us that any petition for a zoning variance is premature and should be summarily denied. The statements by the Petitioner in the pending request do not appear to be accurate or supportable by fact. The Petitioner states that the request is necessary due to the fact that this is a comer lot and has three (3) setback lines. I would call your attention to Lot 1 (398 Pintail Court) in the subdivision which is at the other entrance on the north City of Carmel Planning and Zoning April 19, 2004 Page 2 and you will find that it has nearly identical dimensions, setbacks and easements. Lot 24, 25 and 26 (384, 386 & 388 Mallard Court) are all smaller lots that Mr. Townsend's but contain the same front and rear setbacks, would have governmental side yard restrictions and 24 and 25 contain 15 foot drainage easements along one side. Lot 18 has building setback restrictions on all four sides and probably has less building area than all of the lots mentioned. All of these homes have been built without variance requests. These are but a few exampi~s. Mr. Townsend has additional space along the west of his Lot to reconfigure the footprint of his proposed home to eliminate any setback issues.
