live in the subdivision. Our recommendation for the Townsend home and variance is favorable and this is to express our opinion
that this project will not cause a negative effect on our property or the subdivision. We would not be in favor of the garage door
facing the West, only in this configuration is the sightline adversely affected. As drawn, the position of this home will not cause
the sight line to be Incumbered.

that total five (5) who believe this is a good project for the neighborhood.
h is probable that you will have a lc'ltcr from the HOA opposing my variance request, but I want
to dispute that letter o~ the grounds that not ali HOA members were allowed to participate in the
dccision to oppose the variance. Mr. Jay Brill is one ofthree (3) tlOA members, and .in a phone
conversation, told me he wasn't aware of thc decision ~o oppose before letter was sent, also I
suspect the other member wasn't involved in thc process and just the Presidc~.t Tammy Rely
madc the decision on her own,
Please take in co.n.sideration the comparable small lots arid the HOA r~uirements of side load
garages that make it very difficult to build a home of substantial value in the neighborhood,
especially a ranch. It is a comer lot with monument landscaping that will further reduce the
ability to view tho 7,5 feet of garage, and I feel my substantial home investmc'nI along Springmill
will jump start construction on the less desirable lots that have seen no building activity for
almost five (5) years. I'm willing to invc~t additional landscapi, rllI materials and plants to improve
the comer and look forwa~ to my showing the nice home plans we plan. to build, to the Zoning
Board.

Upon the variance being grarYced by the county, I would agree of the garage
area being 7 ¥= ft. over the building set back I1~. ~nCe the lot ba¢~ up to
Springmlll Road and is a comer lot and the owner has ag~ co due additional
landscaping, I believe it will only enhance the sulxiM$1on due to It shielding
traffic noise and view of Sprlngmlll Road from the subdivision.

Robin, thank you for the support.
If I thought in anyway I was out of line with this request ! would've moved on a couple of months ago, I have other lot options. I
like the Iocation...that ts it pure and simple. People and their fears can never be discounted, and ! know some people if you give
them and inch they take a mile.
I've got two strikes against me, and my meeting went ok with architectural committee last night, I think riley will consider being
neutral if I can cut my garage down to being only a few feet over set back instead of 7.5. I don't think that will be possible since I
have designed only a 2-car garage with a couple of extra feet to put my lawnmover in, but hey I can tell my wife I have to hire
someone to do the mowing and have more time for golfl

taken place last night (we stay busy) as well as earlier meetings. ! feel that if Bruce & Candy Wirth are willing to support
your endeavors in building your home, since it would appear to impact their interests more than mine, I see no problem
with you moving (no pun intended) forward with your construction. I have seen a few things on the south side that we
were told could not happen in our neighborhood when we purchased our home in 1997; i.e., all garages would not be able
to be seen as you entered from Sprlngmill, all homes would be custom built, etc. Since the rules have already been
broken,..
I do believe the one strongest Issue would be, what happens with the next variance request; will the next person want 10-
15 feet etc, etc. We have to have the ability to be flexible, yet not too flexible. In your situation, I feel we need to be
flexi01e.

You may have seen the sign out front of comer lot 38 on Mallard notifying you of your right to affend a Carmel Zoning Meeting. We am
.qolng thmu,qh a variance request due to the fact our 2-car garage extends 7 % feet over the building set back of 35 ft.
The zoning department r~mmended a negative consideration of the request for a variance, coupled with a letter from the Spring Lake
Estate HCA opposing the request will make it tough to build our house on lot 38. The board considem their recommendations, but I get
an opportunity to refute their findings and make my case.
Besides the HOA's letter, the zoning department seems most concerned with the lot adjacent to the east owned by tho Wirth's, and the
effects It possible would have on that property. Their findtngs go on to my that the encroachment of garage will not bo injurious to the
community because it will break the sight line. The Wlrth's have pledged their support to our home plans and will write a letter of
endorsement.
I ask that you mad my attached letter sent to the HCA and Architectural Committee's (AC) that we received no responses back from
yet. If you feel that our home would be a step in the right dlrecl~n for development along Sprfn.qmill Road, I encourage you to reply
back to me with a re.,~pon.,m and your address so I can present It at my meeting next Monday. Home plans are with the AC and I will
leave some additional plans with Candy Wirth, and stake the lot where our front door will be for a visual aid. 1'11 also be attending an AC

Gentlemen:
My wife and I are the owners of Lot 19 which has built upon it one of two houses
that predate the platting of the subdivision. The subdivision was platted with a plat
restriction of a front Building Line Setback of 35 feet applicable to all forty-four (44) lots
and to my knowledge all 32 existing houses comply without amending the plat or
requesting a variance. We would like to express our objection to the proposed variance
for the same reasons as the association has objected but we would also like to add several
observations of our own.
The thirty-five (35) Front Building Setback is shown on the plat, is therefore a
restriction on each lot that runs in favor of and benefits each lot owner and is enforceable
by each of them individually. (See also Article IX, Section 2 of Covenants).
Additionally, the Declaration of Covenants gives to the.owner's association through its
Architectural Committee the fight of approval of the design and location of any house. It
is my understanding that as of this date a complete set of plans/drawings showing the
design and location has not been provided to the committee. My wife and I have not been
contacted to waive our personal fight of enforcement of the front setback restriction and
presume no other property owner(s) has been contacted. It would appear to us that any
petition for a zoning variance is premature and should be summarily denied.
The statements by the Petitioner in the pending request do not appear to be
accurate or supportable by fact. The Petitioner states that the request is necessary due to
the fact that this is a comer lot and has three (3) setback lines. I would call your attention
to Lot 1 (398 Pintail Court) in the subdivision which is at the other entrance on the north

and you will find that it has nearly identical dimensions, setbacks and easements. Lot 24,
25 and 26 (384, 386 & 388 Mallard Court) are all smaller lots that Mr. Townsend's but
contain the same front and rear setbacks, would have governmental side yard restrictions
and 24 and 25 contain 15 foot drainage easements along one side. Lot 18 has building
setback restrictions on all four sides and probably has less building area than all of the
lots mentioned. All of these homes have been built without variance requests. These are

Petitioners. To grant the request will set an example that will most likely have a negative
impact immediately but will also serve as a negative precedent for the development of the
remaining lots along Spring Mill. Mr. Townsend has additional space along the west of
his Lot to reconfigure the footprint of his proposed home to eliminate any setback issues.

In response to the notification letter received on the above docket number, the Spring Lake
Estates Homeowners Association, Inc. is objecting to this proposal. An 8' encroachment on the
35' setback line is excessive.
Setback lines provide for uniformity within the neighborhood. To date, all homes within the
subdivision have been able to comply with current setback guidelines which were established
when our subdivision was platted and approved by the City of Carmel. These homes even
include those located on the cul-de-sac lots which are more difficult due to the lots being oddly
shaped.
Several homeowners modified their home plans to meet these requirements and sacrificied
features within their living space in the process. There are ~still several lots that' remain
undeveloped in our subdivision. By approving this variance, a precedent will be established
within our community and make it more difficult for our Architectural Committee to maintain
uniformity for all the residents.

I have addressed the three comments that were faxed to me on March 18, 2004.
The "proposed garage" has been changed to "proposed house" and the deck has been
removed from the back of the house so it is not in the easement or encroaching'on the rear
yard set back.

2. Mailed and Published Public Notice needs to occur no later than Thursday, April 1, 2004. Published notice is
required within thc Indianapolis Star.
3. Thc Proof of Notice will nccd to bc received by this Department no later than noon, Friday, April 23. Failure to
submit Proof of Notice by this time will result in thc tabling of thc petition.
4. Thc Filing Fee and Eight (8) Informational Packets must bc delivered to BZA Secretary Connie Tinglcy no
later than noon, Friday, April 16. Failure to submit Informational Packets by this time will result in thc automatic
tabling of thc petition to thc Monday, May 24, 2004, agenda of thc BZA.
5. This Item will appear on the April 26, 2004 agenda of the Board of Zoning Appeals under Public Hearings.
6. The petitioner will need to provide a fully filled-out Findings-of-Fact sheets for each petition the night of the

needed.
