STATEMENT OF VARIANCE AND SUPPORT
To allow for construction of a single family dwelling. The garage will encroach 8'
beyond the established building setback line of 35'. There are three building setback
lines that exist on Lot 38 in Spring Lake Estates, which reduces the building area. The
proposed building location will be similar with adjacent houses and will not be
detrimemal to these properties.

To the Carmel/Clay Board of Zoning Appeals;
In response to the notification letter received on the above docket number, the Spring Lake
Estates Homeowners Association, Inc. is objecting to this proposal. An 8' encroachment on the
35' setback line is excessive.
Setback lines provide for uniformity within the neighborhood. To date, all homes within the
subdivision have been able to comply with current setback guidelines which were established
when our subdivision was platted and approved by the City of Carmel. These homes even
include those located on the cul-de-sac lots which are more difficult due to the lots being oddly
shaped.
Several homeowners modified their home plans to meet these requirements and sacrificied
features within their living space in the process. There are still several lots that remain
undeveloped in our subdivision. By approving this variance, a precedent will be established
within our community .and make it more difficult for our Architectural Committee to maintain
uniformity for all the residents.

Dear Adjacent Property Owner;
Please be advised that the undersigned property owner has petitioned the
Carmel/Clay Board of Zoning Appeals for a variance request in Clay Township, Section
35, Township 18 North, Range 3 East, ltamilton County, Indiana On property to be
known as 399 Mallard Court, Carmel, Indiana and located on the East side of Spring
Mill 'Road being 2400' +/- North of 116t~ Street. This request for a variance is to allow
for construction ora single family dwelling, which will encroach approximately 8' over the
established building setback line of 35'.
A copy of this application, legal description, and a development plan pertaining
thereto are on file and available for examination prior to the hearing in the office of the
Department of Community Services in the Ci~ of Carmel, One Civic Square, Carmel,
Indiana 46032, between the hours of S:00 AM and 4:00 PM, Monday through Friday.
Written objections to the proposal may be filed with the Secretary of the Plan Commission
within 10 days after this publication at the above address and such comments will be
considered.
A public heating will be held at the City of Cannel Municipal Building on the 2~a
floor(Chamber Room), One Civic Square, Carmel, Indiana 46032, on April 26, 2004 at
7:00 PM.
