I have received and reviewed your Departm<t Report on the above referenced variance
requests scheduled for public hearing on April 26, 2004, before the Hearing orfieer Board or
Zmfing Appeals. In your mlalysis you state that the food court, welcome m~d office signs have
yet to appear before the Plan Commission for design approval. This is not correct. Under docket
numbcr~:04~02OO3~2~ADLSSA~m.~hTd, we filed and presented the complete sign package, (including
all of the proposed signs listed above), to the Sp~ial-Sm:diesCo~m~7~ittee of the Plan Commission
on M~eh72. Tho Committee approved all of the proposed signs and the design of those signs
with the following modifications: (I) "Thank you for visiting Clay Terrace" will be eliminated
fi'om the back of the entry signage; (2) additional identification will be added to the parking lot
signs because of the large lots; and (3) Westfield Avenue will be changed to Carmel Avenue.
Your analysis also includes a new comment concerning the "size and massiveness" of' tiao
U.S. 31 center identification sigm. Your analysis fails to note that although the height of the sign
has increased from 11'11" to 19' 10", th~si:~:g~_aJs:onlyzl:SO:squ~fee%~w~h~fiie:p~itted sign
~a?C'-x:is-zJ60:f~et~ Clearly, thc sign may be taller, but it is not more massive. As you stated at the
Committee meeting, "the sign heigl~t is a critical issue." From the date we filed applications for
tire amendment in approved sigmtge on February 20, and the application for development
standards variances on March 12, 2004, you acknowledged that although thc height was being
increased, the smaller sign area mitigated the effect of tim taller sign. No mention of concern
about thc size or massiveness of this sign was made either in the Department Report for
March 2 Committee meeting or at the Committee meeting. I do not understand how this is now
an issue when it has not arisen previously with either the Committee or tlm Department.

accurately reflect thc review process and analysis that has occurred with respect to the approval
