As you will note, they already planted three trees where they were marked delay. I propose one additional tree to the southeast by the mini barn, Hopefully that would satisfy the change we have discussed. 1 have also put in a call for Scott Brewer and maybe you can share this sketch with him before he calls me. Westfield, IN 46074 RE: Carmel Hope Fellowship Church, 14535 Carey Rd, Carmel, IN 46032 Mr. Hawley: The Depaittiient has administratively approved your request to delay the installation of some of the landscaping along the south property line for a time limit of 8 years, with the inherent possibility of a church parking expansion to the south. When the time limit expires, the Church will have to either submit a Special Use Expansion application for approval of the church parking lot to the south of the subject site or install the remaining landscaping as shown on the approved landscape plan. The delay in installation of landscaping will expire on August 23, 2014. This delayed approval is with the understanding that the trees /shrubs along the south property line, within 55 feet of the west property line are to be installed, and the trees /shrubs within 39 ft of the east property line, along the south property line are to be installed (see attached site plan). A berm is not shown on the approved landscape plan. Also, your request to amend the building footprint is allowed by the Zoning Ordinance, Chapter 21.05; the special use can be expanded up to 10% of the approved gross floor area without having to reappear before the Board of Zoning Appeals. Your current proposed building addition shows an approximate expansion of 16 which will require Special Use Amendment approval, if it is not reduced to a 10% expansion. The Department asks that you provide a copy of the proposed, amended site plan to our Department and to the Fire Department (Gary Hoyt), to review the new traffic pattern and deletion of the church's drive- thru/drop off area, to make sure there are no fire truck turnaround issues. Basically the petitioner would like to delay the installation of most of the landscaping along the north property line for approx 8 -10 yrs, with the possibility of church parking expansion to the north. The church is at the se corner of 146th st. carey rd. I thought maybe you could administratively approve this request with the above mentioned time limit, and then when the time limit expires they would have to bring the special use expansion application or install the remaining landscaping. Also, the Dept. needs the new percentage of lot coverage (pavement building footprints are included) after that building change drive thru removal. The Dept. will also need the percent of the original approved site plan that has changed. Then, the Dept. can review to see if the berm, fe, and landscaping along the south property line of the site can be amended /removed. Also, what is the church planning to do with the parcel to the south of this site, since they have a purchase agreement on it? Carmel-Hope~Fellowihi~Ch~6h,has applied for development variances. This greatly concerns me for the following reasons: · Property values. It is zoned R-1 for a reason and I believe that it is in Carmel's best interest to keep it that way. Please take into consideration how the board voted against the Veterinarian Clinic that was proposed for the property adjacent to this one. · The property size vs. the size of the purposed building and parking area. · Green space vs. impervious area. · Drainage runoff for the site and upstream. I would appreciate it greatly if the board would take these items into consideration. 14445 Carqy Road Carmel, 46033 31 ~m8~14,. 1~H486033 May20,2004 Dear Board Members, _TI3~ e following statement reflects my concern regarding the approval of the petition of the ~I-~pe-F~-o~i~-Ch~re~7-It is my understanding that this petition is one that will allow a church to be built mad a parking lot to be installed on a piece of property on the sou~eastern comer of Carey Road and East 146th Street. This particular parcel is zoned Residential-1 and has been recently annexed along with other properties in C219 into Carmel. The property consists of an existing brick ranch house with a building lot to the south and another building lot to the north. Why would the City of Carmel cede this land to anything other than Residential-1 use? It would appear that the best interests of the taxpayers living in the immediate area would be best served by maintsining the existing home, and the possible construction of two more homes on the adjacent lots. Those of us who live in C219, with the exception of the Taylor Trace development, which has its own covenants and protection for its twelve properties, need to rely on the City Council and the BZA to represent us in a fair and equitable manner. This is another instance of the pm-chase of a piece of property under the assumption that a use variance would be automatically granted. While one might sympathize with the purchaser's intent, it is not then the responsibility of those who live in the surrounding neighborhood to sacrifice their property values so as to realize the buyer's goal. I respectfully request that you deny this petition, and that you vote to maintain this parcel as a Residential-1 area dedicated to single-family dwellings. Separate BPWS approval will be required if this entrance is to be located any:where other the site of the permanent curb cuts. · Consent to Encroach approvals for any permanent improvement to be installed within dedicated easements and/or dedicated right of way. Performance Guarantees/Engineer's Estimates It does not appear that Performance Guarantees will be required for Phase I. They may be required for Phase II construction, dependent upon receipt of detailed construction plans. 12. Street Cut/Right o f Way PemaJt and Bonding Requirements Any work in the dedicated right of way of Carey Road, not included or covered by a Performance Guarantee, will require a Right of Way Permit and a License and Permit Bond. The bond amount will be detemfined by the number of instances of work in the right of way ~ $2,000.00 per instance. This would include any demolition activities. Open pavement cuts in dedicated streets require approval by our Board of Public Works and Safety. Please contact our Right of Way Manager, Fred Glaser, to arrange permitting and bonding. Based upon the drawings submitted, it does not appear that permits will be required for Phase I. Be advised that work in the right of way of 146t~ Street is under the jurisdiction of the Hamilton County Highway Department. PROJECT COMMENTS-REMODEL PHASE I 13. Since this was a single-family residence, the conversion to a church site will require the existing dfiveway/curb cut to be re-approved by our Board of Public Works and Safety as a commemial curb cut. The City requires that each of the existing street cuts be removed. 14. This conversion will also require Board of Public Works and Safety approval for Water* and Sanitary Sewer availability. 15.Water and Sanitary Sewer Availability and Connection Fees · Availability (acreage) Fees Water, Pamel B* - 0.505 acres ~ $1,010.00/acre = $ 510.00 Sanitary Sewer, Parcel B - 0.505 acres ~ $1.365.00/acre -- $ 689.00 Total Availability Fees, Phase I 0.505 acres @ $2,375.00/acre = $1,199.00 Mr. Donald Hawley May 18, 2004 Page 3 of 4 · Connection Fees Connection Fees for Churches are based upon 0.008 EDUs per Sanctuary Seat. The drawing submitted indieatas 60-occupants for Phase I. If this is incorrect, please advise. Therefore, 60- seats ~ 0.008 EDUs per seat = 0.48 EDUs. Water, Parcel B* - 0.48 EDUs ~ $1,310.00/EDU = $ 629.00 Sanitary Sewer. Parcel B - 0.48 EDUs (&. $ 795.00/EDU -- $ 381.00 Total Connection Fees, Phase I 0.48 EDUs ~ $2,105.00/EDU = $1,010.00 *Assuming the building will be connected to Carmel Water. These fees will be credited with Phase II development. 16. The Carey Road right of way line is not identified or dimensioned on the plans submitted. The City of Carmel 20-Year Thoroughfare Plan identifies Carey Road as a Collector Thoroughfare with a fight of way requirement of 80-feet total, 40-feet half. If the existing fight of way for Parcel B does not meet this requirement, the City will request the dedication of addifional right of way to satisfy our 20-Year Thoroughfare Plan. The plan submitted does indicate the right of way for Carey Road. However, unless this will be platted, the right of way must be formally dedicated through our Board of Public Works and Safety. 17. The City 0f Carmel's Alternative Transportation Plan (ATP) for Carey Road requires the construction of separated, parallel 10-foot wide asphalt paths. I will defer to our Department of Community Services to determine if this path conslruction will be required for parcel B or if it may be deferred to the construction of Phase II. The newplan does not indicate either a sidewalk or a path in the right of way of Carey Road. 18. Is there demolition planned with Phase I? It appears there is a barn or shed on the proper{y. 19. Parking areas are required to be paved and curbed. It may be possible to obtain an exception, given the circumstances of this development. I will defer to our Department of Community Services. The City will allow extruded curbs but does not recommend them. PROJECT COMMENTS-PHASE II CONSTRUCTION 20. Board of Public Works and Safety commercial curb cut approval will be required for the abandonment of existing curb cuts and the construction of the new curb cut. Please be advised that the City will not approve the extension of the entrance median into the right of way of Carey Road. It appears that this median still encroaches upon the right of way. 21. The City requests the construction of deceleration/acceleratinn lanes and a passing blister on Carey Road with Phase II construction. This has not been addressed. 22. Additional Water and Sanitary Sewer Availability approval will be required from our Board of Public Works and Safety. 23. Additional Availability (acreage) and Connection Fees will be assessed with Phase II construction as follows: · Availability (acreage) Fees based upon Tract A and Tract C acreage (0.587 + 0.573 = 1.16) Water, Tract A & B - 1.16 acres @ $1,010.00 per acre = $1,172.00 Sanitary Sewer, Tract A & B - 1.16 acres ~,, $1,365.00 per acre = $1,583.00 Total Availability-Phase II 1.16 acres ~ $2,375.00 per acre = $2,755.00 · Connection Fees Water and Sanitary Sewer Connection Fees for Phase II construction will be based upon the seating capacity of the new church. As indicated above, Connection Fees paid with Phase I will be credited to Phase II. Please be advised that,~vailability and Connection Fees used in Phase I and Phase II calculations are based upon current City of Carmel Utility Fees and are not guaranteed to be the City of Carmel Utility Fees in place when construction commences. 24. The City requires the submission of a drainage plan and drainage calculations with Phase II construction including plans for storm water detention on site. The City has received the drainage calculations for the on-site storm water. It is apparent that there is no on-site detention planned. ~Please provide calculations for the existing pond with confirmation that the proposed development was included in the sizing of the existing detention facility. Please indicate, with the use of flow arrows, how surface storm water run-off will flow including parking areas and greenway. .also, where is the breakpoint at the entrance? 26. Swales less then 1% slope require a sub-surface drain laid at a stope which matches the slope of the swale. 27. Is Structure No. 6 able to be constructed? Please provide 6" above the exterior crown ofthe pipe to the top of tho concrete of the structure. 28. The grading of the eastern parking lot appears to have very shallow slopes. Please ensure that the contractor is able to construct such fiat slopes. 29. Is the spot grade of 847.2 on the west edge of the western parking lot a bust? 30. A Right of Way Asphalt Paving Section is required. This is for the portion of the new entrance within the right of way of Carey Road. The required section is l' ofllll surface over $"of SD base over 7" of compacted #$3 stone. 31. Please indicate the radii of the entrance curbs off Carey Road. 32. ls the existing well to be abandoned? 33. Please detail the tree well noted on the plans. With the apparent grade change at this location, a retaining wall may be required. 34. ShouM the sanitary service for the future sanctuary be installed now? Is the existing sanitary service to the existing residential home large enough to accommodate flows from the final development? 35. Tho northern entrance/exit to the eastern parking lot is less than 24-feet in width. Is it possible to pull the curb back on the east side? 36. Please label bearings and distances of property lines and all required yards and setbacks. 37. As a general comment, the City will e2qoect more detailed plans for this project, including how the construction will be phased. The City will also require a standard set of clvil construction plans including a Title Sheet, Erosion Control, Existing Conditions, Site and Utility Plan, etc. with a readable scale such as 1" = 50: The City reserves the right to provide additional comments upon further review by the City Engineer and submission of more detailed construction plans. The above comments are based upon the Engineering Department's second review. Please provide our office with a follow up letter regarding this review and revised plans, indicating all revisions. Third and subsequent reviews will focus only on detailed cons~uction plans. It is critical that our office be made aware of all modifications made on the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our initial review.
