FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
the Department of Community Services will ensure that the front setbacks of the buildinqs will conform to the
approved development plan adopted by the Carmel Plan Commission.
The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the variance establishes the cr ter a and ,qu delines approved by the Plan Commission in consideration of the use
and value of the adiacent area and properties.
The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
the State of Indiana's plans will cause a hardshio to the aoolicant and its real estate and thereby creatino a
practical difficu ~ n deve opin.q the real estate that needs to be removed by this variance.
DECISION
IT IS THEREFORE the decision of the Hearing Officer of Carmel/Clay Board of Zoning Appeals that Developmental
Standards Variance, Docket No.04040020 V is granted, subject to any conditions stated in the minutes of the
Officer, which are incorporated herein by reference and made a part hereof.
